Research On The Legal System Of Green And Low-carbon Development Of Agriculture

The party’s 20 th Congress proposed that promoting green and low-carbon economic and social development is the key link in achieving high-quality development,which provides important guidance for China’s future economic development and actively response to environmental changes.As the primary industry in China,agriculture is not only an important source of greenhouse gas emissions,but also a huge carbon sink system,which can offset most of the greenhouse gases caused by agricultural production in the operation of the ecosystem.Therefore,vigorously promoting green and low-carbon agriculture is the inevitable way to achieve high-quality agricultural development,is the inevitable requirement to achieve high-quality agricultural development,and is of great significance to realize the "double-carbon" policy and rural revitalization strategy.At present,our country is speeding up the relevant laws and regulations to ensure agricultural development system,the understanding of agriculture,but the agriculture involves interests more,more areas,the lack of relevant legal regulation,innovation system and some absence of necessary system,make agricultural green low carbon development mechanism is not smooth.In order to effectively solve the problem of green and low-carbon development of agriculture,this paper first expounds the overview of green and low-carbon development of agriculture in China,making clear its meaning and connotation.Take the basic characteristics of agricultural green and low-carbon development as the breakthrough point to discuss the interpretation of green and low-carbon agriculture,and clarify the discrimination of relevant concepts.Green low carbon agriculture development involves economics,ecology,this paper from legal research threshold,through the theory of ecological agriculture theory,sustainable agriculture theory,circular agriculture theory,provide theoretical support for our country agriculture green low carbon development,with the necessity of the development of the significance of promoting the development of agricultural green in our country.Secondly,on the basis of literature analysis and empirical research,through the consideration of the green and low-carbon development of agriculture in China,we can explore the problems it faces and explore the root causes.This paper analyzes the current situation of legal construction of green and low-carbon agricultural development in China.At present,China has certain legal system support in agricultural ecological compensation,agricultural non-point source pollution prevention and control,and the development of green agricultural technology,but it still faces legal difficulties such as imperfect legal system,insufficient innovation system and some necessary system lack.Thirdly,to investigate the policies and practices of relevant countries outside the region for green and low-carbon agricultural development.Through to the United States,the European Union,Japan and South Korea’s agricultural development research,explore relevant policies and practices of different countries,for agricultural green low carbon development experience,thus get the following conclusion: establish a complete legal system,strengthen the government support for agricultural green low carbon development and leading,strengthen scientific and technological talent support,commission green low carbon agriculture industry chain value and efficiency,etc.Finally,China’s agricultural green and low-carbon development legal system path arrangement.First,starting with legal principles,we should build a legal system based on the principles of ecology first,public participation and innovation-driven development.Second,we will improve relevant major systems,such as the agricultural cleaner production system,circular agriculture system,agricultural emission reduction and carbon sequestration system,green finance system and farmer education and training system.Third,we need to increase the construction of relevant supporting mechanisms,including the improvement of the standard evaluation system for green and low-carbon agricultural development,the construction of agricultural information support system,the cultivation of the national agricultural carbon sink market and the mechanism for enhancing the value of ecological products.The purpose of this paper is to provide reference for relevant legislation or macro decision-making,and promote the transformation of China’s agriculture from "high carbon" to "low carbon",promote the green development of agriculture,so as to boost the realization of the "two-carbon" strategic goal.
