The Research On Legal Protection Of Urban Construction Waste Resource Utilization In Shanxi Province

In recent years,Shanxi Province,as a rising region in central China,continues to promote high-quality urbanization construction,and the resulting amount of urban construction waste also shows a rising trend year by year,which brings serious environmental pollution problems to the city.The recycling of urban construction waste can not only reduce the environmental pollution caused by urban construction waste,but also fully excavate and realize the neglected resource value of urban construction waste itself.At present,the resource utilization rate of urban construction waste in Shanxi Province is less than 30%.Laws and regulations are the most effective means to promote the resource utilization of urban construction waste.However,Shanxi Province still has some deficiencies in the legal protection of urban construction waste resource recovery,such as lagging legislative idea,lack of local laws and regulations,imperfect legal system and unclear legal responsibility.Therefore,it is necessary for Shanxi Province to formulate special local laws and regulations of urban construction waste resource recovery,perfect the legal system of urban construction waste resource recovery in Shanxi Province,and improve the rate of urban construction waste resource recovery in Shanxi Province by strong legal means.Based on the legislative status quo of urban construction waste reuse in Shanxi Province the research,combined with the status quo of urban construction garbage processing MSW locally,combed the problems existing in the urban construction waste reuse legal protection of Shanxi Province,and analyzed the successful experience of the United States,Germany,Japan and other developed countries reusing and legally protecting urban construction waste,making clear the necessity of urban construction waste resource utilization in Shanxi Province into the legal system.From the perspective of the related subject of city construction waste resource utilization,the research proposed developing urban construction waste resource utilization in shanxi local laws and regulations,strengthening the government supervision,and implementing enterprise’s main body responsibility,four social aspects such as playing the supervision power.In order to promote the green development of cities in Shanxi Province,the paper optimizes the resource utilization capacity of urban construction waste in Shanxi Province from the legal system.
