Research On The Internal Regulations Of National Single Sports Association From The Perspective Of Soft Law Governance

The national individual sports association is an important force to realize the national strategy of national fitness and an important part of the diversified governance structure of China’s sports industry.The 19 th National Congress of the Communist Party of China proposed to "build a social governance pattern of CO governance and sharing,and improve the level of the rule of law in social governance".How to use "soft law governance" to improve the internal governance of national Single Sports Association and realize the governance modernization has become an important content of sports governance research.This paper selects 31 internal regulations of the national Single Sports Association as the research object,and uses normative empirical analysis,literature and expert interviews to conduct in-depth research.This paper is divided into six parts: the first part is the preface;the second part is the theoretical basis of the internal regulations of the national Single Sports Association;the fifth part is based on the improvement of the soft law governance mechanism of the national Single Sports Association;the sixth part is to coordinate the relationship between the internal regulations and the hard law to achieve the "soft hard law co governance" mode.The main conclusions of this paper are as follows: first,this study defines the soft law attribute of the internal regulations of the national Single Sports Association,and makes clear that the internal regulations of the Sports Association have the essential attribute and effect of the soft law.Second,through the analysis of the current situation of the internal regulations published by 31 national single sports associations on their official websites,it is found that,from the perspective of soft law,the internal regulations of national single sports associations mainly have the following problems:the imperfection of the autonomous constitution;the lack of internal management system;the lack of internal supervision system;the duality of internal punishment system;the simplification of internal relief system.Third,combined with the problems existing in the internal regulations of the national Single Sports Association,the paper puts forward the soft law governance path to improve the internal regulations of the national Single Sports Association: self-made articles of association legalization;management system standardization;supervision system institutionalization;punishment system autonomy;relief system pluralism.Fourth,it puts forward the hard law guarantee of the soft law governance of the internal regulations of the national Single Sports Association: "softand hard law co governance" : the rules of soft and hard law co Governance: clear division of labor,targeted;the scope of soft and hard law co Governance: internal and external combination,cooperation;the process of soft and hard law co Governance:autonomy first,procedure first.Under the basic principle of rule by law,we should build a kind of industry autonomy norm that can protect the rights of members and embody the will of members,give full play to its inclusiveness as a soft law norm,and make it continuously perfect.Finally,we can achieve the goal of combining the management of Sports Associations with the management of the state under the mode of "soft hard law co governance",and jointly promote the development of rule by law.
