| In the long history of human development,Equality is not only the ultimate goal pursued by mankind persistently but also the highest value that the law has always pursued.Equality is about human rights harmony and more importantly settle down in peace.Women as an important part of society provide powerful driving force for economic development.They gain economic independence based on employment,thereby realize self-development life value and social status.Although China has made progression in the women’s employment.But the phenomenon that women are treated unfairly in the whole process of employment still exists.In some areas,this trend is even growing serious which is not optimistic.Therefore,it is necessary to investigate the protection of women’s equal employment rights in China which promotes economy social harmony and stability.At the same time,it significantly contributes to the development of equal labor relations.Women’s equal employment rights are not only the prerequisite and foundation of achieving equality between men and women,moreover,it is the key to the solution of women’s human rights issues.Therefore,once women obtain equal rights in employment,they will have more chances to gain equal status in economy and family,consequently achieve their life values.In this study,based on gender equality with the basic principles of women’s equal employment right discusses the importance of guaranteeing women’s equal employment rights and lays a theoretical foundation for the construction of our country’s women’s equal employment rights guarantee system.By exploring the current situation of the legal protection of women’s equal employment rights and the contradictions in women’s employment.This paper finds out the reasons for women’s unequal employment and makes a detailed analysis which are mainly affected by traditional cultural factors personal factors and legal systems.Above all,through the investigation of the outstanding achievements and valuable experience from overseas in guaranteeing women’s equal employment rights,and combining with domestic conditions,we found the shortcomings of the current legislation in protecting women’s equal employment rights.From legislation judicature and enforce aspects we summarized effective scientific methods and raised constructive countermeasure suggestion for maintaining legal protection.On the one hand,it needs the country to improve existing law and regulations,clarify legal responsibilities and unify the standards of employment discrimination.In terms of law enforcement,we appealed to improve relevant law enforcement agencies,establish the authorities of labor supervision departments,and strengthen the supervision of law enforcement.In the judiciary,increase judicial relief channel strengthen the anti-employment discrimination litigation system,and expand the scope of litigation acceptance.On the other hand,the joint efforts of the whole society should build a civilized healthy and harmonious gender culture,optimizing women’s employment environment and consequently solving the dilemma of women’s employment as much as possible. |
