This paper mainly discusses the unequal treatment of women in employment because of gender differences and how to use the law to solve the phenomenon and protect women’s equal employment rights.Ensuring equal employment rights is the most important right in the field of employment.However,in real life,it is no satisfactory,the phenomenon of employment discrimination,women’s equal employment rights have not been effectively protected,contrary to the Constitution to protect women’s equal employment rights.At present,China has made more research on protecting women’s equal employment rights in economic law and labor law.This paper mainly starts from the aspect of legal protection to realize the equal employment rights of women in China to carry out some superficial research.This paper discusses the legal protection of women’s equal employment rights from four aspects.The first part defines women’s equal employment rights.Starting from the two concepts of equal right and equal employment right,this part analyzes the connotation of women’s equal employment right,and then describes the main content of women’s equal employment right in detail from four aspects.The second part mainly discusses the current legal situation of our country in protecting women’s equal employment rights.The first section,on the legislative front,collates the existing legal basis for women’s equal employment rights,the second section discusses the current state of governance of discrimination against women in employment by the Government and the National Women’s Federation,and the third section provides an analysis of the existing judicial relief procedures in the areas of filing cases,proof and legal liability.The third part mainly discusses the difficulties faced in protecting women’s equal employment rights in China.The first section is the lack of specific legislative provisions and operability at the legislative level,which leads to the failure of protective measures,the second section is the lack of synergy between the Government and the Women’s Federation and the failure to implement punitive measures effectively,and the third section is the flaws in the litigation mechanism.The fourth part discusses the legal countermeasures to protect women’s equal employment rights in China:first,complete scientific legislative system;Second,theGovernment and the Women’s Federation actively cooperate in social governance,and thirdly,improve the mechanism of women’s equal employment litigation,broaden and open channels of relief. |
