In the current employment environment,influenced by various reasons such as traditional concepts and fertility policies,women are still at a disadvantage in employment,and women ’s equal employment rights have been repeatedly violated.Women ’s equal employment right is the embodiment of women ’s human rights in the field of employment.As a major group in society,women have an important contribution to society and play an important role in economic development.The protection of women’s equal employment rights is not only related to each female worker themselves,but also to the harmonious development of the whole society.In 2019,the Ministry of Human Resources and Social Security,the Ministry of Education and other nine ministries and commissions jointly issued the " Notice on Further Regulating Recruitment to Promote Women ’s Employment." The " Women ’s Rights Protection Law " promulgated on October 30,2022 also made new provisions on protecting women ’s employment rights.However,because China ’s current laws have not yet formed a systematic,clear and targeted guarantee for women ’s equal employment rights,it is imperative to further protect women ’s equal employment rights.The study of women ’s equal employment rights should start from the definition of women ’s equal employment rights,the relationship between women ’s equal employment rights and related concepts,and take gender equality theory,fairness and justice theory and human rights theory as the theoretical basis.Safeguarding women ’s equal employment rights and respecting women’s legitimate rights and interests are of great significance for safeguarding women ’s personal dignity and promoting the realization of women ’s personal values.Judging from the current situation of the legal protection of women ’s equal employment rights in China,China currently lacks special legislation to protect women ’s equal employment rights,the identification of violations of women ’s equal employment rights is vague,and the legal liability of employers is missing.This leads to difficulties for female workers at the beginning of safeguarding their rights,and they are at a disadvantage in litigation.Coupled with the lack of government responsibility to protect women ’s equal employment rights in China and the imperfect relief channels for women ’s equal employment rights,it is difficult for female workers to get effective relief.Due to the perfect research on women ’s equal employment rights outside the region,the laws of the four typical countries of the United States,Britain,Germany and Norway are formulated specifically and strictly,and there are special equal employment guarantee institutions and judicial relief systems relatively sound,which can provide reference for improving the legal protection of women ’s equal employment rights in China.Starting from China’s national conditions,to protect women ’s equal employment rights,China should formulate a special equal employment law to clarify the legislative positioning of special protection for women ’s employment;clarify the types,identification standards and defenses of violations of women ’s equal employment rights;clarify the legal responsibility and commitment of the employer;through the implementation of the employer ’s tax reduction policy,and the improvement of the care welfare policy to improve the government ’s responsibility to protect women ’s equal employment rights;through the establishment of a reasonable burden of proof distribution system,the establishment of specialized agencies to protect women ’s equal employment,improve the supervision mechanism to protect women ’s equal employment rights to improve the protection of women ’s equal employment rights relief way. |
