The Study On State Obligations Of The Balanced Development Of Compulsory Education In The New Era

To ensure the effective supply of fair and high-quality compulsory education to all children of school age is not only the core guidance of the current reformation of compulsory education,but also the responsibility and mission of the balanced development of compulsory education in the new era.The balanced development of compulsory education should not only enable children to receive education,but also ensure children to get quality education,and give the mission of connotation promotion to the development of compulsory education.As a form of education under the full responsibility of the government,compulsory education embodies the relationship between citizens and the state.The performance of state obligations is the key to the realization of the balanced development of compulsory education.From the perspective of academic theory,the theory of citizens’ right to education and the theory of national education provide theoretical supports for state obligations of balanced development of compulsory education;from the perspective of legal rules,international and regional treaties and current laws of China provide normative basis for state obligations of balanced development of compulsory education;from the perspective of practical development,the achievement and the current governance difficulties of compulsory education show the realistic demands of state obligations of the balanced development in compulsory education in China.Therefore,as the subordinate concept of state obligations,the state obligations of balanced development of compulsory education can be defined as the three obligations of respect,protection and payment.First,the state fulfills the state obligation to respect the balanced development of compulsory education by changing the government’s educational function and respecting the individual’s educational development will.Second,it fulfills the state obligation to protect the balanced development of compulsory education by relying on the legislative,administrative and judicial forces.Third,it fulfills the state obligation to pay for the balanced development of compulsory education by means of material,service and institutional payments.In order to ensure the full implementation of the state obligations for the balanced development of compulsory education,reduce and avoid the adverse consequences caused by the improper performance of state obligations,we should build a complete mechanism of national supervision and relief for the balanced development of compulsory education,and unblock channels for legal relief of state obligations of balanced development of compulsory education.
