A Study On The Procedure Of Filing And Examining The Normative Documents Within The Party

Since the 18 th National Congress of the Communist Party of China was held,it has become a proposition of the times to govern the party in an all-round and strict way.Among them,the construction of inner-party laws and regulations system is an important part of the overall strict management of the party.The 19 th National Congress further stressed that the construction of the party’s legal system is not only a major task of the party’s construction under the new situation,but also an important sign of the gradual completion of the national legal system.Since the promulgation and implementation of the party’s "legislative law",the preparation of normative documents within the party has gradually become the focus of the construction of the party’s laws and regulations.The revised "Regulations on formulation" and "provisions on Filing" of the same name on August 30,2019 further strengthen the importance of the filing and review work.The procedure of record review is essential in the supervision mechanism of the normative documents within the party.Its clarity and refinement significantly enhance the operability of supervision,strengthen the authority of the normative documents within the party,and provide the necessary way for the public to participate in the supervision.The filing review procedure can be divided into three stages: start-up,review and supervision.The start-up procedure includes the start-up subject,review organization,review standard,review time limit and filing materials.The review procedure is composed of formal review and substantive review.The supervision procedure refers to the specific error correction method adopted by the review organ for the problems found in the filing review process.Among the numerous research results,there are argumentation on the improvement of the system from the theoretical aspect,as well as judgment and supplement of specific work content from the practical perspective,but most of them focus on the research of the system itself.From a new perspective,this paper focuses on a more specific filing review process,focusing on the following three aspects of the filing review process: first,define the concept of normative documents within the party,and compare with the relevant concepts,followed by a brief introduction of the connotation,existing provisions and value of the filing review process.Secondly,this paper briefly introduces the current situation of Hunan Xiangtan city’s filing and review procedures,finds that there are some problems in the filing and review procedures,such as unreasonable allocation of review power,non-public procedures,low public participation,lack of accountability mechanism,and analyzes the causes of the problems.Finally,starting from the start-up procedure,review procedure and supervision procedure,aiming at the existing problems,the paper puts forward some suggestions,such as setting up the filing force reasonably,promoting the openness of the procedure,improving the public participation,and improving the accountability mechanism.I hope that through my own discussion,I can make a little contribution to the gradual improvement of the procedure for the filing and examination of normative documents within the party.
