A Research On The System Of Filing And Reviewing The Laws And Regulations Within The Party

Since the 18th National Congress of the Communist Party of China,it has been an important strategy and measure to continuously deepen the construction of internal laws and regulations in order to strengthen the Party’s construction.In order to better supervise the Inner-Party laws and regulations to meet the political,legal,reasonable and normative requirements,the record review system,as a post-review method,has obvious effects,remarkable achievements and deserves attention.It has always been the focus of the work of filing Party regulations to improve the system of filing and reviewing Party regulations,and to connect Party regulations with national laws.The paper takes the opportunity of revising the Provisions for the Record and Examination of the C.C.P’s Inner-Party Laws and Normative Documents(hereinafter referred to as the Record Provisions)to conduct a systematic study on the record and examination system of the Inner-Party laws and regulations.The paper mainly adopts the method of literature research and comparative analysis,from the following four aspects.The first is to briefly discuss the basic contents of the Inner-Party laws and regulations and the filing and examination.Second,it makes a longitudinal review of the provisions of the filing and examination system of Party regulations in different periods from 1921 to the present,and introduces the development process of the five stages of the bud,rudimentary,establishment,development and perfection of Party regulations.Third,partly combining with the current situation of the filing and examination of the Party’s laws and regulations,it analyzes the existing deficiencies in its operation.Fourth,it puts forward corresponding suggestions to improve the existing deficiencies.In order to solve the prominent problems in the practice of the filing and review system of Party regulations,it is suggested to improve it from the following five aspects: First,clarify the standards for filing and reviewing Party regulations,and solve the problem that the standards are not easy to operate.Second,we will improve the system for coordinating filing and review,guide Inner-Party and non-Party institutions in communication and coordination,and resolve the problem of inconsistency between Inner-Party regulations and national laws.Third,improve the record review responsibility system to solve the problem of supervision work floating on the surface;Fourth,to improve the passive review,to achieve the Inner-Party laws and regulations to achieve all-round,multi-angle supervision;Fifth,we will improve the internal procedures of the filing and review system and refine the whole process.
