A Research On The System Of Filing And Reviewing The Laws And Regulations Within The Party

Rules are the foundation of the rule of law.If a political party wants to promote the rule of law and the level of party governance,it must first formulate scientific and reasonable inner-party laws and regulations in the way of thinking and ruling by law,which is to ensure there are laws to abide by.And secondly,it should ensure that these inner-party laws and regulations have absolute authority and effect.Strengthening the review of internal party regulations is not only helpful for correcting problems and improving the rationality,but also conducive to supervision and implement to maintain the legitimacy and authority.The current system of reviewing and filing of internal party regulations is still in the period of improvement,and there are still many deficiencies and problems.How to optimize and upgrade the record review system within the party's laws and regulations,and to respond to practical needs in practice,is a practical problem currently facing.Based on theoretical analysis,realistic problems,and path exploration,this article systematically studies the filing and review of laws and regulations within the party.After briefly discussing the concept,theoretical basis,and functions of the system of reviewing and filing of internal party regulations,through data research,the firstly is the longitudinal analysis of the institutional arrangements in different periods,followed by the institutional achievements and problems,and finally the causes of the problems.Secondly,through comparative analysis between systems,drawing on the beneficial experience of the People's Congress and the government's experience,it provides suggestions from the perspective of substantive regulations and procedural regulations which is to resolves the outstanding issues in the work.It mainly includes six parts.The first is to construct a constitutional review system to resolve the unreasonable problems.The second is to enrich the legal compliance review standards and rationality review standards to solve the difficult operation problems.The third is to improve passive review to achieve both active and passive review.The fourth is to improve the accountability system for record review and establish system rigidity.The fifth is to establish and improve the linkage mechanism to strengthen the coordination between party committees,people's congresses and governments.From the six aspects of registration,review,result,correction,feedback,handling,and disclosure,the sixth is to improve the record review procedures within the party's laws and regulations,and promote the level of institutionalization,standardization,and routinization.
