| Following the promulgation of local regulations on family education in Guizhou,Shanxi and Chongqing,Jiangxi province,in light of the actual situation of Jiangxi province,the regulations of Jiangxi province on the promotion of family education(hereinafter referred to as the regulations)came into force on December 1,2018,the regulation was enacted at a time when all parts of the country attach great importance to the development of family education and improve the legal system of family education,setting the responsibility of family,school,government and social organization in the form of system will not only help to build a perfect family education system,but also promote the legalization of various family education mechanisms.For family education,the ordinance makes it clear in special provisions that the family education referred to in this paper only refers to the education of minors at the family level,and pays special attention to the education of children,but does not include the education of family members to adults.The legislative evaluation mechanism is an important way to effectively test the effect of local legislation and improve the quality of local legislation,at present,many local legislatures are actively carrying out legislative evaluation.This paper takes the implementation of the regulations in A city and b county of Jiangxi province as the research perspective and evaluates the implementation effect of the regulations in specific areas after legislation.In order to further improve the implementation effect of the regulations and related mechanisms of family education,it is necessary to evaluate the implementation effect of this local regulation,and the regulations have been implemented for more than a year,short-term assessment is feasible.According to the survey,families,schools,governments and social organizations have achieved initialresults in the aspects of law popularization,publicity and training,but they also face some problems in the implementation process,for example,the coordination between the regulations and some laws and regulations,the unclear responsibilities of relevant departments,the lack of responsibility system for volunteers to disclose their privacy,the lack of supervision and evaluation mechanism for the purchase of family education guidance services by the government,the urgent need for training for social organizations,and the lack of comprehensive establishment of parent schools,etc,if these problems are not solved,it is not conducive to the implementation of the regulations and the coordination of laws and regulations in the implementation level.The thesis is divided into three chapters.The first chapter summarizes the reasons and significance of the topic,summarizes the existing theoretical and practical research status of family education at home and abroad,and establishes the method and process of post-legislation evaluation.The second chapter makes a comparative analysis of family education policies and regulations,finds out the discordant places between the lower law and the upper law,and summarizes the problems and analyzes them by sorting out the data obtained from the field investigation.The third chapter summarizes the research conclusions based on the survey data and puts forward Suggestions for improving the text of the regulations,the relevant mechanism of family education should be optimized from the aspects of ensuring the coordination of laws and regulations in the implementation level,establishing and improving the relevant mechanism of linkage service of family education between families,schools and communities,the government should fully implement the supervision provisions and improve the system of government purchasing family education services.At present,there is little literature available on the open website on post-legislation assessment of laws and regulations related to family education,this study has a certain novelty.Besides,the short-term post-legislation evaluation of the regulations is helpful to examine the problems in the implementation of various mechanisms,which is of great significance for optimizing the related mechanisms of family education.In addition,there are theoretical research bases related to family education in the academic circle,and many scholars have conducted in-depthdiscussions on how to carry out post-legislation evaluation.The innovation of this paper lies in the combination of the two to achieve the purpose of optimizing the relevant mechanism of family education. |
