On The Perfection Of Post-evaluation Of Local Legislation In China

Since China is a unified and unitary country,it has formed a unified and hierarchical legislative system which is not in line with the unbalanced economic and social development of various regions.Local legislation,as an important part of the legislative system,is an important part of the socialist legal system with Chinese characteristics.The further development of economy and society puts forward higher requirements for the continuous improvement of our socialist legal system.People begin to pay attention to the quality of legislation and the actual effect of law from quantity.Therefore,it is particularly important to study and improve the evaluation system.As an effective way to improve the quality of legislation,the post-assessment of local legislation should play its full role.This paper will focus on three parts to analyze the problems arising in the post-assessment of perfecting local legislation in China.The first part is an overview of the current situation of post-assessment of local legislation in China,putting forward its concept and specific principles of evaluation,and at the same time putting forward the post-assessment of local legislation.The development status as a starting point,from which we can find the problems in the post-evaluation of local legislation,that is,the second part of this article.The third part is mainly to analyze and find out the Countermeasures for the problems existing in the post-evaluation of local legislation in our country,to normalize and institutionalize the construction of post-evaluation mechanism of legislation,and to analyze the indicators influencing the legislative effect from the aspect of post-evaluation criteria of local legislation in order to construct a theoretical study of post-evaluation of legislation combining generality with characteristics,and to further analyze it.Significance and necessity.At the same time,the scientific index system and the corresponding evaluation methods and theories are discussed.The feedback of the evaluation results should further improve the full use of the evaluation results after legislation,and improve the normative documents by constantly strengthening the theoretical research and using the evaluation results,so as to improve the law and better guide social life.The construction of its index system and evaluation method as the core link of evaluation will be the focus of this study.The purpose of this paper is to study and analyze the current situation of legislative evaluation,and summarize the shortcomings of legislative evaluation in China,in order to improve the level of local legislation and improve the post-evaluation system of local legislation.
