Research On The Third Party Participation In Post-Legislative Assessment

The third party participation in post-legislation assessment means that third-party entities,such as experts,stakeholders,non-profit organizations,and the public,who are not part of the enacting or implementing organs,participate in the evaluation activities of existing regulation and legislation and make a difference.Through the participation of third parties,it is possible to make the post-legislation assessment activities more objective,fair,scientific,and open.Therefore,the third party participation in post-legislation assessment is one of the effective ways to improve the post-legislation assessment system in China.Although third-party has participated in post-legislation assessment,it is,for the moment,still not perfect.In this regard,this paper hopes to propose some constructive suggestions to improve the third party’s participation in the legislation in China by exploring the actual situation of third party participation in the post-legislation assessment in China and the experience of third parties participating in the post-legislation assessment in abroad.First of all,in the first part of the article,through the introduction and description the concept of post-legislation assessment in our country,as well as the concepts such as “third party” and “participation,” we clarified the connotation of third party participation in the post-legislation assessment and explained the practical significance of our country.Then,in the second part of the article,we introduced the overall development situation of China’s post-legislation assessment and the current status of third-party participation in the post-legislation assessment.It can be found that there are many deficiencies in the current Chinese third-party participation in the post-legislation assessment.Next,in the third part of the article,through the research of the post-legislation assessment system of western countries,we found out that they have some experience in third-party participation in the post-legislation assessment system.Finally,the fourth part of the article,at the basis of the enlightenment brought by extraterritorial experience,this paper put forwards some constructive and perfect suggestions,aiming at the current problem in our country’s third-party participation in the post-legislation assessment.
