The judicial staffing system is the "cow nose" of the judicial reform,the important content of realizing the professionalization of the trial,the professionalization of the team and the elitism of the talents,and the premise of ensuring the judicial reform to be carried out in place.The promotion of the judicial staffing system is the key to the realization of the objective of impartial justice,which is conducive to improving the quality and efficiency of judges in handling cases,establishing judicial authority,effectively resolving the contradiction of "fewer judges and more cases",and improving the judgment level of judges.At present,China has basically completed the reform of the judicial staffing system,but it has been accompanied by many problems and contradictions.Therefore,the construction of a professional,professional,healthy competition trial team is the key to the following reform.This article consists of six chapters.The first chapter is the introduction,which expounds the research background and significance of the topic selection,reviews the relevant literature,introduces the main research methods and innovations of the article,and determines the writing methods.The second chapter introduces the outline of the post system for judges,including its connotation,basic contents,basic characteristics and basic values.The third chapter expounds the current situation of the full implementation of the post system reform in our country.The current situation of each pilot implementation includes four pilot provinces and cities of Shanghai,Beijing,Liaoning and Guizhou,and the results achieved.The fourth chapter comprehensively analyzes the difficulties faced by our country in the reform process: imperfect admission selection mechanism,severe brain drain of judges,and insufficient allocation of judicial assistance.The fifth chapter introduces the judge system,characteristics and experience of the United States,Britain,Japan and Germany.Finally,it puts forward the way out to solve the problem: improve the admissionselection mechanism,strengthen the professional security of judges,improve the auxiliary team of judicial personnel and implement the case diversion mechanism,etc.,in an effort to promote and perfect the reform of the judicial system. |
