Research On The Quota Of Judges In China

The post system of judges refers to the number of judges determined by the number of cases,population density,court settings and other factors,and the centralized exercise of national jurisdiction.Once a post is determined,it can not be changed for a certain period of time.The rapid development of China's economy,the diversity of social contradictions,the improvement of public awareness of the law and other practical factors all put forward more and higher requirements for the court to play the social function of settling disputes.Although the legal and judicial circles have been exploring and exploring the post system of judges to varying degrees,since June 2014,the Third Meeting of the Central Leading Group on Comprehensive and Deepening Reform has considered and adopted the Framework Opinions on Several Issues Concerning the Pilot Reform of the Judicial System and the Pilot Program of Judicial Reform.As the first pilot area,Shanghai opened the curtain of China's judicial reform.The reform was piloted in Shanghai,Hainan,Guangdong and other six provinces and municipalities to explore the practical experience of judicial reform.From the beginning of 2014 to the first half of 2015,the number of judicial reform pilot areas increased to 18 provinces(cities and districts)in China.In 2016,the leading group of the CPC Central Committee's comprehensive and deepening reform approved the "Request for Pilot Reform of the Judicial System in All Areas of China",and agreed to carry out the judicial reform pilot work in 2016 in 13 provinces such as Beijing,Tianjin,Hebei,Henan and Xinjiang Construction Corps.This means that the judicial system reform was fully pushed forward in 2016.At present,the judicial reform has entered an important stage of comprehensive and deepening reform.While summing up experience,it also exposes many problems.For example,measures such as the post system of judges are still not legalized,the proportion of judges is not reasonable and so on.It is normal for the reform to produce problems.The important thing is how to face the problems and solve them.This article solves them one by one.The thesis consists of five parts:the first part is the main content and evaluation of China's judge post system;the second part is the case analysis of Hainan's judge post system implementation;the third part is the practice of foreign judge post system and related experience;the fourth part is the improvement measures of China's judge post system.By consulting the literature,the author studies the theory and practical experience of the system of judges at home and abroad,and chooses Hainan as an example to study the implementation of the system of judges'posts,analyzes the existing problems of the system of judges' posts,and puts forward some measures to improve the system of judges'Posts suitable for China's court system.
