A Brief Analysis Of The Legal Regulations On The Candidate Recommendation System Of Political Parties In China And South Korea

The election system and the party system occupy the core position of the democratic political system.In western countries,elections are closely related to the party system.The most direct manifestation is that democratic elections are the only legal way for political parties to gain power.Therefore,political parties need to recommend competitive candidates for public office who can better represent the interests of the party and fund their election victory,which makes candidate recommendation the most important activity of contemporary political parties.As the preposition procedure of the electoral system,the system of recommending candidates by political parties is also an important link in the connection between political parties and the electoral system.Therefore,it must be regulated in the constitution,electoral law and other national laws.At the same time,as recommending candidates is an activity within a party,the procedure and content of the activity should be regulated by internal party regulations.Therefore,the division of labor and connection between national laws and internal party regulations are also important contents worth studying.This paper is divided into the following five parts:The first chapter is "introduction",briefly expounds the research background,research purpose,significance and research ideas.The second chapter is "an overview of the candidate nomination system of south Korean political parties".Firstly,from the analysis of the relationship between political parties and public office elections in western countries,this paper expounds the development process of the system of "party recommending candidates",and summarizes the significance of the system of party recommending candidates in elections.Secondly,this paper expounds the system of candidate recommendation by political parties in South Korea,and focuses on the evolution process of the system of candidate recommendation by political parties for presidential candidates and members of parliament in South Korea after democratization.The third chapter is "the legal regulation analysis of the candidate recommendation system of Korean political parties".Firstly,it expounds the regulations on the system of recommending candidates in the national laws such as the constitution,the public office election law and the political party law of the republic of Korea and the specific procedural provisions in the intra-party laws and regulations.Secondly,on the basis of describing the relations between different norms,this paper summarizes and analyzes the relations and functions between national laws and intra-party regulations in the legal system of recommending candidates for political parties in South Korea.The fourth chapter is "the ruling Chinese communist party legal regulation analysis",by explaining the general situation of China’s ruling party candidate recommendation system,in turn and China’s National People’s Congress on behalf of the recommended candidate recommended change process of the legal regulation and China’s National People’s Congress on behalf of the candidate status of legal regulation,etc.,generally combed the legal regulation system of China’s ruling recommend candidates.The fifth chapter is "the comparison and reflection on the legal regulations of the candidate recommendation system of Chinese and Korean political parties".Through the comparison of the legal regulations of the candidate recommendation system of Chinese and Korean political parties,it summarizes the similarities and differences between the two parties in the system,and analyzes the root causes of these differences.In addition,this paper summarizes and analyzes some characteristics of the legal regulation of the system of recommending candidates of political parties in South Korea and provides some necessary references and inspirations for us.
