Research On The Systematization Of Railway Administrative Regulations Alteration

After the announcement of the “Notice of the General Office of the State Council on Further Altering the Regulations and Regulatory Documents Involved in the Reform of “Decentralization,Administration and Services” in 2017,” various national ministries and commissions and local governments at all levels responded actively and carried out a series of Alteration activities and abolished A number of regulations and normative documents that do not conform to the provisions of the higher-level law and the actual reform and development have been published,which have a positive effect on maintaining the unity of my country’s legal system and the harmony of the legal system.As the practice of alteration becomes more abundant,theoretical research on alteration also needs to be further strengthened to respond to problems that arise in practice.On the basis of summarizing the alteration activities of the State Railway Administration,this paper analyzes the problems existing in the alteration work and the institutional causes of the problems,and puts forward some suggestions,such as improving the alteration type,establishing the responsibility orientation of the alteration subject,improving the alteration procedures,and strengthening the follow-up connection system,Help the institutionalization construction of railway administrative norms.This article is divided into five parts.In the first part,from the value of alteration activities to maintain the unification of the legal system and the background of the alteration initiated by the reform of "decentralization,management and service" in recent years in my country,it explains the reasons for choosing the alteration practice of the National Railway Administration as the empirical research object,and summarizes the research ideas of this article.The second part is to clarify the related concepts of the railway administrative norms alteration system.Through the discussion of the term administrative norms,the level of railway administrative norms is clarified,and the connotation and functions of the railway administrative norms alteration system are analyzed through the discussion of the legislative attributes of the alteration system.The third part summarizes the characteristics of the 17 batches of alteration practices carried out by the National Railway Administration since 2017 from the aspects of alteration basis,alteration subjects,alteration procedures,alteration standards,and alteration results.The fourth part,based on the problems existing in the alteration practice of the National Railway Administration,puts forward the aspects that need to be further improved.Including the purpose of the "task-oriented" alteration model needs to be optimized,the principles for determining the subject of the alteration need to be clarified,the content of the alteration standard is not clear,the operability is insufficient,the democratic participation procedures for the alteration need to be improved,and the information disclosure of the alteration results needs to be strengthened.The fifth part,on the basis of drawing lessons from other departments’ alteration experience,combined with the alteration characteristics of railway administrative agencies,proposes methods to promote the institutionalization of railway administrative norms alteration,and puts forward specific alteration suggestions for current railway administrative regulations.This article hopes that through the above research,the railway administrative organs will improve the lack of alteration systems,and through institutionalized operations,the future alteration work will be incorporated into the standardized operation track,improve the level of alteration work carried out by the railway administrative organs,and promote the reform of the railway system and mechanism.Meet the actual needs of railway development.
