Over the past 40 years of reform and opening up,China’s various industries have achieved rapid development.Among them,the construction industry has maintained a rapid development speed,expanded its scale rapidly,and gradually increased its proportion in the national economy.It has gradually determined its status as a pillar industry and continuously promoted the development of the national economy.However,with the gradual expansion of the scale of development,many problems are gradually exposed.Among them,the disputes caused by the contract price account for a large proportion in the construction project disputes,and the number of contract price disputes cases has also increased in recent years.Contract price disputes affect the smooth implementation of construction projects.In order to solve the disputes,both parties need to pay a lot of money and time,which is not conducive to the interests of both parties,but also to the healthy development of the whole industry.Therefore,it is necessary to deeply analyze and discuss the influencing factors of contract price dispute of construction project,so as to take effective control measures to reduce or avoid the occurrence of contract disputes.According to the logic of "raising problem—analyzing problem—solving problem",this paper sorts out the relevant research literature of contract price dispute at home and abroad,understands the current research situation in this field,and puts forward research problems.Based on the contract status theory,transaction cost theory and the cost control in the completion settlement stage,20 influencing factors were determined by literature analysis and expert interview.This paper constructs an evaluation model,uses AHP to analyze the importance of each influencing factor,obtains the key influencing factors,and then puts forward the corresponding control measures.Taking a residential construction project as an example to verify the applicability and rationality of the measures.The analysis results show that:from the point of view of management level,the contract clause setting,the legal quality,the contract validity,the project content,the good faith degree,the performance behavior,the time limit,the quality,these nine factors are the key factors that affect the contract price dispute.In the actual construction process,both parties should focus on the preventive control of these factors.Combined with the influence degree and control effect,the paper puts forward control measures for the factors of the contract parties,and suggests that the contract parties should strengthen the training of Engineering legal knowledge,establish the sense of integrity,standardize the performance of contract,and improve the level of contract management.For the factors of the contract itself,the employer and the contractor should start from the prevention of invalid contract and the reasonable formulation of contract documents to ensure the effectiveness,integrity,clarity,fairness and rationality of the contract.For the factors of the project itself,this paper analyzes the contract price disputes caused by the changes of the scope and content of the project,the compilation of the construction scheme,the quality and the construction period,and puts forward three measures,including clarifying the project content,strengthening the project quality supervision,and formulating the construction period control plan.This paper studies the influencing factors and effective control of construction project contract price dispute,aims to identify the influencing factors and put forward corresponding control measures,which enriches the research on contract price dispute to a certain extent,hoping to provide theoretical reference for construction project managers and help managers to effectively control construction projects with focus and pertinence. |
