A Study On The Legal System Of Horizontal Ecological Compensation In The Yellow River Basin

Due to the shortage of water resources in the Yellow River basin,the development of the river basin is greatly limited.Water resources are the lifeblood of the local economy and culture.In recent years,with the rising demand for economic development,water resources,water environment and water ecological quality have been deteriorating,seriously endangering the future development of the river basin.And the use of ecological compensation can get rid of the above predicament.Vertical ecological compensation mainly depends on the special allocation of the central finance to the areas in need of ecological compensation,which has direct subordination,determined procedures and limited subjects.Horizontal ecological compensation is the compensation reached between equal subjects.Through consultation and negotiation,there is a wide range of subjects and more diversified compensation methods.There is no fixed compensation procedure and form,so there is a large space for development,so it has more value for research and discussion.The ecological compensation system requires the ecological consumers who make groundless profits because of the free enjoyment of natural resources to pay a reasonable compensation to the ecological protectors to restore the ecological environment of the river basin and make up for the actual losses of the ecological protection party.At present,a number of ecological compensation areas formed within the Yellow River basin have begun to take shape.After years of exploration and research,a lot of effective experience can be accumulated,but there are still many problems to be solved in the actual operation process.This paper discusses the pilot projects of horizontal compensation,and considers that the top design of horizontal ecological compensation is insufficient,leading to the lack of science,the unreasonable subject and scope of compensation,the need to draw on the successful experience of ecological compensation at home and abroad,combining the actual situation of China,and diversify the compensation methods.To speed up the Yellow River basin horizontal ecological compensation national level legislation,improve the relevant system supporting measures,in order to provide clear guidance for orderly horizontal ecological compensation practice,realize the sustainable development of natural resources,promote the national ecological civilization system construction,provide experience for the Yellow River basin protection big management.
