In today's world, the problem of the water resources become highlight of the matter, water pollution, water shortage caused by numerous of related issues. Due to entanglement of how should the water resources being develop and protect seriously affected our today's society's harmony and stability. So, finding the solution for the water resources' development is the root to solve the water resources' issue, and it demand immediate attention. Yet, recoup ecological system is exactly what we need to resolve the problem of water resources, and it will be like panacea to the issue. Use economy and legal measure to restrict access of the water resources' development between the upstream and the downstream of the river, to let beneficiaries burden, to make protector compensate. The government's-led and the market's self-adjust should be the method that applied for countervail while the legislation pay close attention to the compensation to the ecological. Develop appropriate regulations, or develop special law will permanently turning the theory of ecological compensation into a practice mode.In this thesis, I start with explore the concept for the basic theory of ecological compensation, discussed related theory, basis theory, primarily focused on ecology compensation theory, and ecological compensation theory. By combed the theoretical basis for ecological compensation, such as external theory and the theory of economist, at the same time, analyzed environmental responsibility of the new development for the ecological compensation's performance from a new prospective of view. Then use the method focuses on empirical analysis of foreign practices on the experience of ecological compensation and summed up the relevant Inspiration for our country. Afterwards, analyzed the compensation of our current ecological status of theoretical study, and practical experience, identified the problem.The core of the thesis, primarily focused on envisaged the legal regulation of ecological compensation system, including description of the legislation's issue for the ecological compensation, the basic principle for the ecological compensation legislation, the object, the method, the standard, and the principal part of the ecological compensation, the supervision and management of ecological compensation mechanism and the source of funding for the ecological compensation. These aspects of the system covered main concern of the ecological compensation, among the issue, focused on what the government's plan for local ecological compensation, wish to find pattern in the summary that could contribute for establish the legislature of ecological compensation.
