Research On Legal System Of Ecological Environmental Damage Compensation Fund

With the gradually development of ecological civilization,China attaches more and more importance to the protection of ecological environment.The problem of compensation and remediation after environmental pollution has become the focus of current environmental reform increasingly.Since the "reform plan on the compensation system for ecological environment damage" has been issued,the academic circles have been discussing constantly how to build the ecological environmental damage compensation system legitimately.Many scholars puts forward constructive opinions based on theoretical and practical basis and many interesting ideas have sprung up.The exploration and construction of the compensation system for ecological environmental damage in various provinces and cities is also in full swing.As an important part of the restoration of ecological environment,the compensation damage of ecological environment damage has attracted great attention in theory and practice,different provinces adopted different management methods according to the actual situation.The main research problem of this paper is how to manage the huge amount of ecological and environmental damage fund and how to ensure the ecological and environmental damage fund timely applied to the restoration of damaged ecological environment.After the introduction of the < Measures for the management for compensation fund for ecological environment damage(Trial)>,Some scholars once again proposed to establish a fund system to manage the compensation funds for ecological damage by drawing lessons from the implementation experience of the extraterritorial environmental damage compensation fund system,this paper analyzes the emergence background,implementation experience,funding source,management form and specific use of the extraterritorial environmental damage compensation fund,draws on the advantages of the extraterritorial environmental damage compensation fund system,and avoids the problems and lessons encountered in its development path.When establishing the compensation fund system for ecological environmental damage in our country,we should pay attention to strengthening the theoretical basis,optimizing the management and use mode,increasing the channels of fund sources and perfecting the supervision mechanism,giving play to the institutional advantages of the fund system in the aspect of ecological environmental protection,and better using the compensation fund for ecological environmental damage for ecological environmental protection and restoration.Make up the Insufficient of the methods adopted in the existing practice,establish a special fund management center to manage the operation of the fund,and ensure the professionalism,flexibility,efficiency and scientificity.To achieve the purpose of timely repairing the damaged environment when the responsible person is not clear or unable to assume the responsibility,to promote the sustainable development of ecological civilization,and to promote the more perfect development of the ecological damage compensation fund system by comprehensively considering the interests of the liable person and the victim.
