Legal Guarantee For The Management And Operation Of Ecological Environment Damage Compensation In China

At present,the current situation of China’s ecological environment is that enterprises pollute,the masses suffer and the government pays the bill.In order to solve the practical problem of China’s ecological and environmental protection,the general office of the CPC Central Committee and the general office of the State Council issued the pilot scheme for the reform of the ecological and environmental damage compensation system in 2015.On the basis of pilot projects in individual provinces,the pilot scheme for the reform of the ecological and environmental damage compensation system was issued in 2017.From only policy provisions to the implementation in seven provinces,and then to the national trial,China’s ecological environmental damage compensation system is being promoted step by step,but there are still many problems in the implementation process.Therefore,speeding up the research process of ecological environment damage compensation is a big matter and can not be ignored.This paper focuses on "the legal guarantee for the management and operation of ecological environmental damage compensation",and summarizes four management modes of ecological environmental damage compensation in China: turning over to the state treasury,setting up a special account,setting up a foundation and being managed by the people’s court.At present,the problems existing in China’s ecological environmental damage compensation are mainly reflected in the following points: insufficient institutional basis,chaotic management and operation of ecological environmental damage compensation,imperfect supervision and evaluation of ecological environmental damage compensation,and so on.In view of the above problems,while adhering to the general direction of respecting,conforming to and protecting nature,we should speed up the legislation of ecological environmental damage compensation system from four aspects,determine the management subject and use procedure of ecological environmental damage compensation,improve the supervision mechanism of ecological environmental damage compensation and establish a unified post evaluation system of ecological environmental damage compensation,Ensure the construction of an integrated ecological environmental damage compensation system in all provinces and cities throughout the country.
