On The Legal Issues Of Chinese Environmental Damage Compensation Fund

Chinese Environmental Damage Compensation Fund is an important part of the construction of China's ecological environment damage system.With the continuous promotion and improvement of China's environmental public interest litigation system and ecological environmental damage compensation system,the legal attributes,legislative necessity and claims of ecological damage compensation are clarified.The main body,management subject,management and application have become the key issues in the construction of China's ecological environment damage system.This paper applies the methods of literature research,comparative research and empirical analysis to the legislation,judicial and administrative social practice of ecological environmental damage compensation.According to the analysis,it is found that the current ecological damage compensation has unclear legislation,the claim path and the subject are unclear,the existing management subject is limited,the fund management and the use is not perfect,and so on.This paper analyzes the legal problems of its existence with the current theory and practice,and strives to provide feasible suggestions for the legal problems of the current ecological damage compensation in China.Through the analysis and research of its problems,this paper believes that the solution to the compensation for future ecological environmental damages in China should be the introduction of special legislation for compensation for ecological environmental damages,and the determination of compensation for existing ecological damages,such as the claim body and the order,clear The scope of funds,the improvement of its evaluation and appraisal mechanism,and the better relief of the compensation for the protection of ecological environmental damages should be established as soon as possible.
