Investigation Of The Legal System Of Community Co-Management Natural Reserves In China

The establishment of natural reserves is of vital importance in maintaining biodiversity.As the area and amount of natural reserves in China are relatively high,the contradiction of functional departments and local residents has been a knot problem in the process of protection.Therefore,leveling the relationship of protection and development is virtually indispensable.In the past practice of executing the protection,the unilateral emphasis on the importance of natural resources from the officials indirectly disfranchises the local resident’s right of resource rational utilization,which not only hinders the protection initiative of the community but limits the economy development.Aimed at this problem,introducing the community co-management model is recognized as a positive role in coordinating reserve protection and economic development.Nonetheless,there are still many factors to restrict the proceedings of the community co-management.Meanwhile,China is undergoing a national park system reform and advocates the establishment of a national park-based nature reserve system.Accordingly,more efforts should be demanded to level the relationship of the ecological protection and the rights and interests of stakeholders for proceeding the systematical reform.This master thesis centering on the legal system of community co-management natural reserves in China firstly elaborates the basic connotation and theoretical basis of the community co-management,analyzes the ongoing situation of the community co-management in Qilian Mountain Nature Reserve in Gansu,and summarizes the problems in terms of its legal status,natural resource property rights,financial investment and ecological compensation for community residents,by which the problematic commonalities of the community co-management natural reserves in China is proposed as an effective finding.Consequently,the outlook of future development is discussed with the workable experiences all over the world as the referenced cases.Furthermore,based on the understandings of the legal system,guarantee system,and national park-based protection system of the community co-management model,the detailed perspective on the operation and development of the community co-management natural reserves in China is provided.
