On The Legislation Of Natural Land Protection In China

China is a vast country with many natural protection areas.However,there are many problems in all kinds of natural protection areas at present,such as unclear protection objectives,poor management and insufficient funds for protection.therefore,it needs further regulation by law.In addition,the review and adoption of the guidelines on the establishment of a natural reserve system with national parks as the main body on January 23,2019 also showed that the establishment of a natural reserve system cannot be separated from the protection of laws,which also accelerated the process of legislation on natural protection areas.In order to further implement general secretary Xi Jinping’s view of ecological rule of law and implement the strictest ecological environment protection system,it is urgent to legislate for the protection of natural areas.Australia and the United States in the field of natural protected area management is quite effective,based on the two national natural reserve of legislation to protect the historical process of exploration,in the understanding of the two countries on the basis of the characteristics of the model of legislation,protection,our country is in the land of the wilderness and local indigenous protected area under the management style of the appropriate reference,and should attach great importance to public participation for the natural protected area,make public management mechanism for the natural protected area.Through analysis,I believe that we should make a fundamental law in the field of natural protection land in our country,namely the law on natural protection land,and improve the level of the legislation,so as to make legislation scientifically and improve the quality of legislation.First,the legislative purpose and values of the act should be clarified,and the basic principles of the act should be formulated to distinguish it from other laws.Secondly,the legislative characteristics of the law should be highlighted,and the status of the law in China’s legal system and its legal attributes should be clarified.Finally,by optimizing the protection objects of the law,a series of systems such as management system,public participation mechanism,broadening the sources of funds,and legal liability determination are developed as the main contents.To sum up,adopting the comprehensive legislative model,the enactment of the law on nature conservation land is more in line with China’s national conditions and can also highlight the characteristics of Chinese law.
