The local characteristics of the social acquaintances in the countryside make the rule of law in the rural environment weaker.The collective members of the village jointly manage various natural resources such as collective land and water resources.When they are closely connected with each other,it is easy to form an order commonly agreed.Therefore,it is not absolutely dependent on the national mandatory law.The author believes that the village regulations have the dual attributes of administrative management and private contracts,calling it the self-government norms under the will of the country,which can better reflect that the village regulations are formed by the villagers ’spontaneity and democracy,and can also reflect the state ’s involvement in rural grassroots Social governance.The author starts with the analysis of the texts of village regulations of some typical villages in our country,and finds and further clarifies that the village regulations can play a new role in the construction of beautiful villages in the new era.Specifically,in the case of weak national laws governing the rural environment,the village regulations,by virtue of their unique advantages,act on the weak links of the rule of law and can make up for the lack of the rule of law;they can fully play the decisive role of the market,Leading role of government administration,promoting public participation,thereby promoting pluralistic co-governance of the rural environment;able to lead ideological concepts;able to sort out relationships among grassroots governments,village committees,villagers,and social forces to form a joint force for environmental governance;Optimize the management of rural environmental affairs and improve the efficiency of environmental governance of village committees and village collective members.At the same time,the intervention of village regulations in the governance of the rural environment still faces problems such as insufficient protection of democracy,insufficient scientific drafting of texts,inadequate application and implementation,and conflicts with laws and regulations.Based on this,the author proposes that the judicial reference meaning of the village regulations should be given,and the legality review should be strengthened to ensure that the formulated village regulations cannot limit the basic rights of citizens;it is necessary to use environmental science theory as a guide to construct rules that conform to the laws of environmental protection To strengthen the scientific and reasonable formulation process;before drafting the village regulations,an extensive survey of villagers ’opinions should be conducted to enhance the democratic participation of village collective members;in order to ensure the application of the village regulations,the author proposes that the village committee should have a special The cadres will take charge of the construction of village regulations,establish an effective supervision mechanism,make rewards and punishments clear,and promote the application of village regulations,thereby playing a preventive and educational role.
