From “Dependency”to “Legal Entity”:Research On The Governance Structure Transition Of Rural Collective Economic Organizations

Long-term stable and continuous improvement of the management system which based on both household contract operation and combination of unified and decentralized management is the basic regulation for rural collective economic organization,and also the basic policy established by the party in rural areas.However,current rural governance system has "trinity management" and "the party and commercial management" phenomenon,that means rural party organization,autonomous organizations and collective economic organizations run at the same time.At the same time,people often emphasize "individual division" but ignore the role of "overall management".The role of the rural collective economic organization not only fail to contribute to strengthen collective economy,but also becomes the dependency of the village committee due to lack of legal entity authority.Under the background of rural revitalization strategy,this essay analyze the historical vertical evolution of rural collective economic organizations governance structure and illustrate three cases in Huizhou city in two dimension and do horizontal comparison,then summarizes the characteristics,advantages and disadvantages,and holds the view that legal entity governance structure has its unique advantages,and it's the best choice for collective economic organization governance structure transformation.The essay can be divided into five parts.The first part mainly introduces the research background,significance and research methods,while also analyze and comments the existing research at home and abroad;The second part proposed the rural collective economic organization governance structure transformation development tendency through illustrating collective economic organization development course in China;The third part points out the superiority of legal entity governance structure by doing both empirical and comparative analysis for three different collective economic organizations operation status in Huizhou.The fourth part puts forward the realistic foundation of constructing the rural collective economic organization legal entity governance structure.The fifth part points out the way to construct legal entity governance structure among rural collective economic organization.
