Analysis On The Current Situation And Influencing Factors Of The Transfer Of Rural Homestead Use Right In Liaoning Province

Based on the field investigation of the basic situation of rural residential areas in three typical areas of liaoning Province,central-southern of liaoning plains and coastal area,northwest of liaoning and eastern of liaoning mountainous areas,this paper grasps the circulation of the right to use rural homestead in liaoning Province.This paper analyzes on the factors affecting the circulation of the right to use the rural homestead in liaoning Province,clarifies the problems existing in the circulation of the right to the use of the rural homestead in liaoning Province,and puts forward some suggestions for perfecting the reform of the circulation of the right to use the rural homestead in liaoning Province.The results show that the factors that affect the circulation of rural homestead use right in liaoning Province mainly include four aspects: population change,farmers,families and rural homestead.On this basis,they are divided into farmers' age and educational level in detail.Type of occupation;Family population,annual income,migrant population;rural homestead area,number,distance from the city,etc.At present,there is still a unclear definition of land property rights in the circulation of rural homestead use rights in liaoning Province,the rights and interests of farmers have been infringed,the circulation mode of rural homestead use rights is too single,farmers do not have enough understanding of the law,and their willingness to transfer is not clear.Rural homestead idle situation,rural homestead use right circulation income distribution,withdrawal compensation mechanism is not perfect and so on.In order to solve these problems,it is suggested that legislation should be strengthened,policies should be issued,examination and approval should be made clear,property rights should be clearly registered,property rights should be clarified,markets should be standardized,land management intermediary organizations should be improved,income distribution should be completed,and compensation mechanisms should be withdrawn.Strengthen rural legal education and publicity and other countermeasures.
