enforcement,consumer rights protection,and market supervision.In order to ensure better functioning,the market supervision and management department also needs to innovate ideas and improve mechanisms,and proactively understand,adapt to and lead the new normal.As the front line for service performance,it is imperative for the urban market supervision and management department to reform.The National "Two Sessions" held in March 2018 made major arrangements for the institutional reform of the State Council.In May 2018,the second meeting of the Central Committee for Reform set a "timetable" for local institutional reforms,demanding that the reforms be initiated.At present,the system adjustment of industry and commerce,quality supervision,and food and drug supervision at the national level has been completed.The State Administration of Market Supervision was officially unveiled on April 10,and the reform of the market supervision system at the provincial and municipal levels across the country is also in full swing.The market supervision department is responsible for the supervision of all three major departments,food and drug safety,commodity quality,special equipment,trademark advertisement,contract and commodity consumption rights protection.Under the new situation that the major policies of the system reform of government agencies at all levels have been clarified,as the municipal market supervision department,after the “three in one” of the state,provincial industry and commerce,quality supervision,and food and drug,how to act in accordance with the requirements of the system reform,proactively and efficiently perform all duties and improve of market supervision effectiveness are issues that must be studied and solved at present.This study focused on the performance of the market supervision department through the investigation and research of Market Supervision Administration in H City.The article is divided into three parts.The first part is the introduction,which analyzes the research background and significance,the research status at home and abroad,research ideas and research methods.The second part is the main boy,which is divided into three questions.The first question is about the concepts and theories related to market regulation.Firstly,the concept of market supervision and its functions are defined.Market regulation refers to the process of monitoring activities of the parties entering the market and their transactions according to law through the establishment of special market supervision and management institutions,the use of necessary administrative means and certain legal means and relevant social supervision mechanisms;the market supervision and management function is the objective function of the state market management authorities acting on the management object in the implementation of supervision and management activities,and is divided into normative functions,supervisory functions,and investigation functions in the content.Secondly,it introduces the theoretical basis of market supervision,mainly including government function theory,organizational structure flatization theory,new public service theory and governance theory.The second question analyzes the status and effectiveness of the performance of the Market Regulatory Authority in H City,as well as the problems in the performance of duties and the factors that constrain the department to perform better.Firstly,it summarizes the performance of Market Supervision Administration in H City,including No.1: strengthening the cultivation of market entities and deepening the reform of the commercial system;No.2: safeguarding the legitimate rights and interests of consumers and increasing protection;No.3: regulatory normalization of “double random,one open";No.4: increased market supervision and administrative enforcement.Secondly,it analyzes the problems in the performance of Market Supervision Administration in H City.The first one is that the market supervision function is too broad;the second is that the market supervision system is not wholesome;the third one is that the imbalance between comprehensive supervision and professional supervision;and the last one is that the power between government departments cross.Thirdly,it analyzes the factors that restrict the efficient performance of the Market Supervision Administration in H City.The first is simply superimposed management mode;second,there is no precise positioning;third,human resources and rule of law resources are insufficient;fourth,the cadre management mechanism is not be well-organized;fifth,creating a new situation of social co-governance and national participation.The third question is to propose countermeasures for market supervision departments to perform their duties effectively.Based on the positioning of market supervision functions,this study combines relevant domestic and foreign experience and lessons,and proposes practical countermeasures to further improve the ability of market supervision and performance: The first is the scientific division of powers,including the comprehensive and professional division of functions and the scientific division of supervisory authority;the second is to promote the reform of market supervision and enforcement system,including the promotion of reform of comprehensive administrative law enforcement system,the "double random,one open" supervision and strengthening of law enforcement of key areas;The third is to effectively integrate the leadership team,including strengthening the cadre team building and achieving the optimization of professional supervision talent team;the fourth is to strengthen the rule of law and the development of informatization,including using the rule of law to ensure market supervision and performance and using informationization to promote the market supervision and performance of duties.The third part is conclusion,combing and summarizing the full body.After analyzing the current situation of the case of Market Supervision Administration in H City,we will further propose countermeasures for effective performance of duties by locating the cause of the problem.Although countermeasures for efficient performance of duties have been put forward for the market supervision department,the analysis of the interaction between the subject and the object of market supervision is insufficient,and it is not analyzed from the perspective of market participants.The author will strive to conduct more in-depth research on this issue in the future. |
