| As a new punishment system,"community correction" has the advantages that the traditional punishment system of imprisonment does not have,and has also abandoned some inherent defects of imprisonment.On the other hand,as the embodiment of the new concept of government governance,"community correction" can be classified into the categories of "third-party governance" and"social governance".In the specific judicial practice,it abandoned the traditional management concept of "steering" and "rowing" of the government,opened the closed criminal justice system to the public,and actively encouraged the public to participate in it.The specific implementation of community correction requires the leadership of community correction departments and the participation of multiple departments,organizations and people in the supervision and management of correction objects,which is exactly the process in which the government opens the originally closed criminal justice system to the public.In western developed countries,the implementation of social correction has a history of nearly one hundred years,accumulated a large number of practical experience,and developed a relatively complete system accordingly.Community correction in China started its pilot work in Beijing,Shanghai and other five cities in 2003.After eight years of pilot work,it began to be piloted in other cities across the country.In 2014,it began to be comprehensively promoted nationwide.Due to the late start and lack of experience in community correction in China,compared with western developed countries,there are still certain gaps in system construction,department construction,social volunteer participation and social institution development.As a judicial worker,the author deeply feels the importance and necessity of social correction in judicial practice.For this reason,this paper takes H district of Y city as an example,based on the theories of community governance,ecosystem,government purchase and civil society,and by using the methods of participatory observation,literature research and interview,this paper analyzes the current situation and problems of the community correction practice in the H district of Y.Through the study,the author found that,on the one hand,the H district of Y city community correction from scratch,from the individual to the general,the correction method is increasingly rich,infrastructure tends to improve,the social participation gradually strengthened.But on the other hand,there are also a series of problems,such as high regulatory pressure,unreasonable classification,single correction methods,weak social participation and so on.Community correction is originally to use the resources of the society to eliminate and alleviate the focus of the society,but the existence of the above problems makes this "social medicine"can not really play a practical effect,the treatment of the "social focus",the core concept of social governance can not be realized,community correction into community department correction.:In fact,the causes are insufficient construction of community correction departments,insufficient participation of social forces and insufficient development of social institutions.In particular,the low recognition of community correction by the public and the weak marketization of the social institutions of community correction greatly inhibit the development of the H community correction society participation,making it difficult to play the actual function as the core force of community correction.Therefore,improving the legal system of community correction,building a regularized full-time team of community correction,and enhancing the degree of social participation in community correction will be a reasonable and effective countermeasures to improve the H community correction work in Y city. |
