In recent years,with the increasing number of old houses,the whole society pays more attention to the maintenance funds.How to ensure the rationalization of maintenance funds in the collection and use,and maximize the social utility,is the most difficult problem of the maintenance fund management.Residential special maintenance funds,is earmarked for residential common parts and the funds of repair and renovation of common facilities after the expiration of the warranty.Because of its relationship to the citizens housing in the use of normal operation in the life cycle,the government has given high priority.In February 1,2008,the Ministry of construction,Ministry of Finance jointly issued the "residential special maintenance fund management approach"(hereinafter referred to as the"management measures")of special maintenance funds deposited,and the legal responsibility of the relevant provisions,but in practice,many contradictions,cannot be effectively implemented.For example,in order to ensure the use of the safety of the maintenance funds,does not infringe the legitimate rights and interests of owners,"management measures" clearly stipulates the use of maintenance funds paid to residential special maintenance funds disbursed within the scope of the proprietary part of the total area of the building more than 2/3 of the total owners with more than 2/3 of the owners to discuss using the recommendations.In practice,it takes one month,a few months or even a year to complete the condition.Such as elevator failure,roof waterproofing and other projects can not wait until after the vote.In Management measures,there is no clear the source of expenditure of maintenance funds management departments,which led to the maintenance funds departments throughout the country charge expenditure patterns,basically in the state of non-compliance,embarrassing situation.Due to the start time of our maintenance funds later,most of the city established maintenance fund management institutions in 2008,many problems in all aspects result in the use of the maintenance funds in the average rate of less than 1%,greatly reducing the residential special maintenance funds in meaning.In this paper,the use of maintenance funds rate of more than 10%of the city of Dalian as an example,combined with the use of maintenance funds across the country,through the use of maintenance funds,deposit,settlement,return to the maintenance fund allocation cycle analysis,find out the existing system of our country maintenance funds,in combination with the situation of our country,draw lessons from some advanced countries Japan,the United States and other management methods,put forward the corresponding solutions and suggestions.
