On My Country's Legal Regulations To Prevent The Invasion Of Alien Species

With the rapid development of transportation enterprises in our country and international trade,especially under the policy of "area",alien species invasion phenomenon tends to intensify.Invasive species not only have caused economic threat to our our country’s agriculture,forestry,fishery and other various fields,but also a serious threat to public health and safety,and other fields in China,which hinders the chairman xi’s advocation of the construction of ecological civilization.Now the law of the invasive species control and prevention has become a hot issue of law.A new environment to the international community has established a large number of legal documents to regulate invasive species.The world also develops a rich characteristic of legislative mode and legal system of prevention andcontrol of invasive species,especially as New Zealand,Japan and other countries have been at the forefront of the prevention and treatment of legislation.Our country do not have a special law regulation invasive species,relevant prevention and control of the content of the invasive species distributed in "the entry and exit animal and plant quarantine law","the wild animal protection law","environmental protection law" and other normative legal documents.Although these legal documents has certain positive role in the prevention and treatment of invasive species,but it still has many problems,leading to the prevention and treatment of invasive species to reach the best effect.This article aims to regulate the Angle of the prevention and treatment of invasive species at home and abroad legislative analysis and integration,from the legislative purpose,legislative mode,management system and supporting system to perfect our legal countereasures for the prevention and control of invasive speciess.In the structure of the article,the main body of the text is divided into five parts:the first part is the introduction part.Through the analysis of the background of the research on exotic species and the current situation at home and abroad,the paper puts forward the necessity and feasibility of studying the legal regulation of alien species.In the second part,the main purpose is to invade the foreign species in our country.The legal regulations and normative documents of the legal system are combed,and the legal regulations of the current prevention and control of alien species invasion are analyzed.There are insufficient legal regulations,lack of systematic regulation,narrow scope of legal adjustment,and lack of specific system.The third part mainly introduces the universal adoption in the world.The international legal documents and international principles to prevent invasion of alien species,and the comparative analysis of the legal countermeasures for the invasion of species in the United States,Australia,New Zealand,Japan and the United Kingdom were selected,and the legal analysis was carried out to obtain some reference.The fourth part mainly aims at my national defense.In the four aspects of legislation,legal principles,legal systems,and international cooperation,the suggestions for improving the legal regulation of alien species invasion are proposed in the four aspects of legislation,legal principles,legal systems and international cooperation.The fifth part mainly acts as the summary of the full text and puts forward the prospect of the future.
