Ideally,each species would stay within its original ecological area and not disturb each other.However,affected by the gradual increase of international economic and trade and the continuous deepening of international exchanges and other factors,species gradually break through the limitations of the original region,cross-regional flow is more frequent,due to the lack of rational thinking and calm judgment on the introduction of species,the phenomenon of invasion of alien species has become more frequent,biodiversity has been seriously damaged,and biosecurity has been greatly threatened.At present,the international community through a large number of international conventions and other legal documents to deal with the invasion of alien species,many countries have also carried out a relatively perfect legislation and the establishment of related systems,but China's research on alien species started late,"Inbound and Outbound Animal and Plant Quarantine Law" and other relevant laws and regulations,although through the inspection of animals and plants entering and leaving the country to reduce foreign invasion,indirectly protect biosecurity,but the scope of its quarantine is limited to the import and export list,the purpose is also to promote the development of foreign trade,It is not possible to effectively control the invasion of alien species in all aspects,so under the background of China's biosecurity being included in the national security system,in order to protect China's biodiversity and implement the concept of sustainable development,it is imperative to legislate against the invasion of alien species.On the basis of the research on the relevant concepts of alien species invasion and biosecurity,this paper discusses the adverse impact that alien species invasion may cause on China's biosecurity and the current status of relevant legislation in China,summarizes the necessity and feasibility of china's current legislation to deal with alien species invasion,and proposes that China should begin to formulate a special law to prevent and control the invasion of alien species.Drawing on the legislative experience of the international community to deal with the invasion of alien species and the legislation of representative countries to deal with the invasion of alien species,it makes suggestions on the problems existing in the legislation to deal with the invasion of alien species in the context of China's biosecurity.Although legislation is not achieved overnight,it does not mean that it is necessary and feasible to deny China's legislation to deal with the invasion of alien species,and a sound legal system is the premise for the prevention and control of invasive alien species,especially in the context of the current biosecurity,accelerating relevant legislation to improve the legal system is crucial for implementing the concept of national security and promoting the modernization of the national governance system and governance capabilities.
