Problems And Countermeasures Of Commercial Registration System In China

Commercial subjects,after obtaining the permits from the registration authorities in the application of events such as establishment,registration modification and termination of businesses in accordance with relevant laws and regulations of the State should register the applied content and make announcement to the public,such actions are called commercial registration.In western countries,commercial registration system has been well developed and the essence and reasons is the maintaining of benefits of the businessmen and the thriving commodity economy.Under the system of capitalist economy which not only greatly stimulated the development of western commodity economy but also made commercial behaviors slowly becoming independent from civil behaviors which result in the prevalence of commercial registration system.However,the fundamental purpose of commercial registration system in China is not for the maintaining of businessmen's benefits,but for the convenience of the country in management and controlling industry and commerce even the whole society.Commercial registration as the first step to enter the market,its system is an important part of the economic system.In China,the development and deepening of socio-economic,and gradually improved social and economic system,the current commercial system has been unable to adapt to the new economic development trend and extent.Commercial registration system the current social economy demands cannot be met due to the deficiencies and defects and among which the main shortcomings are:efficiency is not emphasized in the approval but market transactions safety is the only factor to be concerned,the legal system is not centralized and the existing time and the developing level is limited.Therefore,the development and reform of the existing commercial system is particularly important.In this paper,based on empirical analysis of Commercial Registration in China,current situation and basic problems are deeply analyzed and finally the proposal for improvement are raised.The paper is divided into five parts where the first chapter is the instruction.In second chapter,a brief statement for the basic situation of China's commercial registration is made and a comprehensive overview is conducted from the aspects of system origination,the basic situation of the legislation,as well as the principle of censorship etc.In chapter three,the problems existing in the reform of commercial registration system in China are put forward.In the fourth chapter,an in-depth exploration is made to analysis the causes of insufficiency of the commercial registration system of China.Then,in chapter five,referable recommendations are proposed against the existing commercial registration system of China.
