From the"Invincible(reputation)Infringement Case of the Five Heroes of Langya Mountain"to the later case of Ye Ting's descendants prosecute Rage Comic then to the insulting advertisements about Qiu Shaoyun on TikTok and Sogou.In recent years,the phenomenon of insulting heroism in cyberspace is innumerable,and the subjects involved are also more complex,such as scholars,self-media,and online advertising and so on.This phenomenon has attracted the attention of public opinion and has gradually become a hot topic.It has also promoted the progress of the protection of the personality rights and interests of the heroes in China,such as the formulation of Article 185 of the "General Principles of Civil Law",and enactment of the "Hero Martyrs Protection Act of the People's Republic of China" in May 2018.(As a special kind of nentwork phenomenon,the phenomenon of network propagation communication insulting heroism has also attracted the attention of many scholars.)A large part of the research is to explore the understanding and application of the "Hero Martyrs Protection Act of the People's Republic of China" from the legal point of view,There are also some studies that classify it as historical nihilism,but there are few studies to probe into the reason and regulation method of this network phenomenon from Communication subject.This paper takes case analysis and content analysis as the main research methods.On the one hand.it sorts out heroes,martyrs,reputation and reputation rights and related concepts from the macro aspect as the background material for this analysis.On the other hand,taking the"Invincible(reputation)Infringement Case of the Five Heroes of Langya Mountain",the case of Ye Ting's descendants prosecute Rage Comic and the case of the insulting advertisements about Qiu Shaoyun on TikTok and Sogou as the specific cases to analyze.This paper analyzes the concrete manifestation and harm of the phenomenon of insulting heroism by network propagation,and tries to explore the deep causes and regulation methods of insulting heroism by different network subjects.The basic framework of the paper is as follows:the introduction part.This partmakes a detailed introduction to the source of the topic,the selection of samples and the research methods,etc.Then,in the first chapter,the introduction and related concepts of the hero,the martyrs,the reputation and reputation rights will be introduced,which lay the theoretical foundation for the following analysis.And the second chapter to the fourth chapter are parts of the case study of this paper.It analyzes the reasons and performance of infringement in three cases,namely,"Invincible(reputation)Infringement Case of the Five Heroes of Langya Mountain",the case of Ye Ting's descendants prosecute Rage Comic and the case of the insulting advertisements about Qiu Shaoyun on TikTok and Sogou.Finally,The fifth chapter returns to our country our country heroic person protection regulation present situation.This paper investigates the status quo of foreign heroic martyrs' protection legislation,hoping to draw lessons from its advanced experience,and to analyze the deficiency of our country's heroic protection legislation in order to promote the development of our country's heroic protection.
