Study On The Legislation Concerning The Customs Facilitation Of The Free Trade Port In Hainan Province

On April 13,2018,President Xi Jinping solemnly announced that the Party Central Committee decided to support the construction of a free trade zone on Hainan Island,support Hainan’s gradual exploration,and steadily promote the construction of a free trade port with Chinese characteristics,and aid to establish a free trade port policy in Hainan Province step-by-step.This shows that the Free Trade Zone in Hainan Province is the cornerstone of the free trade port,and the free trade port is an upgrade of the Free Trade Zone.All FTA policies will be preserved in free trade ports and will be more open and free.The "Guiding Opinions on Supporting Hainan’s Comprehensive Deepening of Reform and Opening-up" was issued,and made a major deployment to the construction of Free Trade Port in Hainan Province.Article 10 proposes to investigate a more flexible policy on internal and external trade,investment and financing,fiscal and taxation,financial innovation,entry and exit,etc.The "Free Trade Zone General Plan of Hainan Province" involves many contents about custom facilitation,which are absorbed by the free trade port.Based on the advanced relationship between the Pilot Free Trade Zone and the Free Trade Port in Hainan Province,the customs facilitation system in the policy document is also the basis of the Free Trade Port’s customs facilitation policy in Hainan Province.The general plan of the Free Trade Port in Hainan Province.will be based on these policies in the future.The Free Trade Port Law in Hainan Province defines part of the general plan for a free trade port through law.The Standing Committee of the National People’s Congress has initiated the legislation of the Free Trade Port Law in Hainan Province to ensure the facilitation of customs clearance at the Hainan Free Trade Port at the national legal level.Based on the development of free trade port in Hainan Province,this paper is divided into four chapters to study the custom facilitation system of the free trade port in Hainan Province.As an overview,the first chapter studies the connotation and extension of the Free Trade Port in Hainan Province and customs facilitation,the customs facilitation is divided into four sections,apply to customs,check,taxation and discharged,and then defines the customs facilitation of the Free Trade Port in Hainan Province with special characteristics.The custom facilitation of the Free Trade Port in Hainan Province refers to the fact that the Free Trade Port in Hainan Province is located outside the domestic border,exemption from customs duties,and exploring the other matters to improve the efficiency of customs facilitation.At the same time,the current legislation on the customs facilitation of the Free Trade Port in Hainan Province.The second chapter introduces the necessity of the customs facilitation legislation of the Free Trade Port in Hainan Province;the third chapter explores the legislation of the advanced free trade port custom facilitation in Asia,including Singapore,Hong Kong,and Taiwan Free Trade Port.Then,combining the enlightenment of Hainan’s legislative status,it helps to find problems and make suggestions.The fourth chapter proposes feasible legislative proposals for the problems of the Free Trade Port in Hainan Province.Including the legislative name and contents,such as the special regulatory principles,tariff exemption,special single windows,departmental cooperation and risk prevention and control.At the same time,the author writes some legal design ideas for the Hainan Free Trade Port Law in the end of the thesis.The author suggests that the contents about customs facilitation should be divided into two special chapters,freedom of goods and risk prevention and control,this two chapters in the legislation to improve the custons facilitation of the Free Trade Port in Hainan Province.
