Study On Legal Problems Of Chinese Medical Group

Since its emergence and development,the medical group has received extensive attention and attention from the society.It has positive significance for realizing doctors' value,alleviating contradictions between doctors and patients,rationally allocating medical resources,and promoting social medical treatment.China's medical groups have a late start and a short development time.They still face many problems in the development process.Among them,legal issues have become a key factor restricting their development.Compared with China,the American medical group started early,developed fully,and the relevant laws and regulations are relatively perfect,which is worth learning.Using literature analysis method,subject frame analysis method and comparative research method,master the development and research status of Chinese and American medical groups,summarize the data of stakeholders,and analyze the legal problems of medical groups in China.Compare the relevant laws and regulations of the Chinese and American medical groups,draw on the relevant laws of the American Standards Medical Group,and combine the reality of China to provide reasonable suggestions for improving the legal norms and policies of the Chinese medical group.The legal problems faced by medical groups in China mainly include internal legal issues such as their status,nature,organization,operation and legal liability when medical damage occurs,as well as external legal issues with governments,hospitals and medical insurance institutions.By comparing and analyzing the relevant laws and regulations of the Chinese and American medical groups,and drawing on the useful experience of the United States in applying the laws and regulations to the medical group,combined with the actual situation in China,we make recommendations on improving the relevant legal norms and policies of the Chinese medical group: First of all,the status,nature,organization and operation of our medical group are clearly defined in law.The legal status of the medical group should reflect the subjective status of the practicing physician,the industrial nature of the medical group and the clarity of legal responsibility.It is recommended to encourage the development of non-profit medical groups,explore special forms of general partnership organization,further standardize the operation and service content of medical groups,and effectively supervise and manage medical groups.Secondly,promote the physician's multi-point practice system and further improve the legal system for physicians to practice freely.At the same time,improve the medical insurance system,and include non-profit medical groups in the designated units for medical insurance reimbursement,and truly promote the flow of medical resources.Finally,improve the medical liability insurance system and reduce the medical risk burden of the medical group.Figure2,Table5,Reference58...
