Research On The Protection Of Seafarers' Rights And Interests In Dalian Precinct

The protection of seafarers' rights and interests has become the focus of' promoting the development of seafarers in China,the seafarers' rights and interests as an important factor reflecting the social status of seafarers',It attracted attention in various cities in our country and others.Protecting the rights and interests of seafarers not only promotes the development of the ocean transportation industry,but also reflects the governance capacity of our government.As the most important port city in Northeast China,Dalian Prefecture first launched many convenient crew services,after 5 years of hard work,the protection of the rights and interests of seafarers in Dalian Precinct has achieved some certain results in terms of seafarers' education,convenient seafarers' service,and the disputes over seafarers' labor contracts.It was well received in the protection of the rights and interests of seafarers,but it still failed to reach the ideal state.This paper takes the protection of the rights and interests of seafarers in Dalian Precinct as a research object,utilizing the combination of theoretical research and applied research,and the combination of questionnaire surveys and interview surveys,applying the theories of seamless government,market failure,and new public services,considering the status of Dalian,the status quo of the seafarers' rights and interests protection in Dalian area is analyzed from the three aspects of the government supervision and management of seafarers'education and training,the convenience of seafarers' services,and inspection of ships and seafarers 'employment companies.And the problems existing in seafarers' rights and interests protection are explored,at the same time,the causes of these problems are studied in depth.The government's insufficient publicity on the protection of the rights and interests of seafarers ' has resulted in the seafarers' lack of the clarity on their rights and interests,and they do not know how to safeguard their rights when their rights and interests are damaged.The dynamic supervision and management of the protection of the rights and interests of seafaring crew members is weak,resulting in many of the seafaring crews' rights and interests being at a blind spot for monitoring.The labor market supervision and management of seafaring crew members is not so strict that seafaring crews' labor market is chaotic,and there is a market failure phenomenon of survival of the not fittest,and the overall quality of seafaring crew members is not high.The welfare of seafaring crew members is not complete,resulting in uneven social welfare treatment for seafaring crew members.By delving into the successful cases of the protection of the rights and interests of seafarers' in UK,Singapore,Japan and Guangzhou.Ningbo,Haikou in our country,paying attention to their developing characteristics and learning from their successful experiences.It has a high reference value for protecting seafaring crew members' rights and interests in Dalian Precinct.Based on the research on the protection of seafarers' rights and interests in other cities in our country and others.combined with the practical problems of the seafarers 'rights and interests in Dalian Precinct,we can extract some lessons and apply them in Dalian Precinct,such as:multi-department joint supervision and management,strengthening rights and interests protection publicity,playing the role of industry associations actively,and establishing a perfect welfare system,etc.While improving the protection of the rights and interests of seafarers in Dalian Precinct,it also provides a reference for other regions in China.Taking the status quo of the protection of seafarers' rights and interests in Dalian Precinct as a starting point,combining with relevant experiences of our country and others,four major suggestions were put forward:First,we must strengthen the publicity and education on the protection of the rights and interests of seafarers,enhance the training on the protection of seafarers' rights and interests,and promote the seafarers knowledge updating of rights and interests.Second,we must improve the dynamic supervision and management of the protection of the rights and interests of seafarers,establishing standards for the dynamic supervision and management of the rights and interests of seafarers,and promoting the building and using of facilities for the dynamic supervision and management of seafarers'rights.Third,strengthening the supervision and management of the seafarer's crew labor market,promoting joint enforcement of Human Resources Security Departments and the Maritime Safety Administration,using civil organizations to authorize certification of crew service agencies and formulate standardized uniform labor contracts.Fourth,the welfare benefits of seafarers should be improved,the salaries of seafaring crew members should be protected,the seafaring crew members ' insurance standards should be formulated,the seafaring crew members' medical insurance should be improved,and the seafaring crew members' social relief should be guaranteed.The protection of the rights and interests of seafarers will improve the social status of seafarers,will improve the overall quality of seafarers and save ship operating costs.By protecting of seafarers' rights and interests,the happiness of life,the comfortability of work and the professional belonging of seafarers will be improved,the cooperation among government departments will be promoting and the authoritative role of industry associations will play actively.Strengthening the protection of the rights and interests of seafaring crews will achieve a multi-win situation for the seafarers,the ship owners and the social civil organizations.
