The pollution monitoring and management system of our country has undergone major reforms in recent years,and gradually established a framework for enterprises assume the responsibility of monitoring subjects.Enterprise self-monitoring has provided support and guarantee for the environmental management systems.In order to better understand the self-monitoring of Chinese enterprises,this article defines the concept of self-monitoring,summarizes its characteristics through comparison with other monitoring methods,and conducts a value analysis from the perspectives of regulators,enterprises and the public,then sorts out Its evolution from inception to development.On this basis,first of all,based on the enterprise's self-monitoring of the obligations and selection criteria of the obligation subject,analyze the reasons for the allocation of the obligation subject,and propose perfect measures for non-key enterprise incentives that are not allocated with mandatory obligations.Secondly,it discusses the legality standards for enterprises to perform their self-monitoring obligations,sorts out the evolution and types of legal requirements,discusses the authenticity,completeness,and accuracy of enterprise self-monitoring requirements in different aspects of monitoring,and analyzes the implementation of legal requirements in practice Faced with the problem,the implementation details of gradual improvement of obligations are proposed.Finally,for existing enterprises to monitor the setting of illegal liability on their own,analyze the prevention and deterrence effects from the appropriateness and necessity of the principle of proportionality,propose a scientific design of fines,improve the punishment of the person in charge of the enterprise,and distinguish the intentional fault of the offender.Mentality and other ways to improve the legal liability setting.
