Research On The Legal Issues Of The Self-monitoring System Of Pollutant Discharge Units In My Country

In the report of the 19 th National Congress of the Communist Party of China,it is clearly proposed to build an environmental governance system with government a s the leading role,enterprises as the main body,social organizations and public participation.The implementation of the self-monitoring system of pollutant discharge units makes the subject of environmental responsibility get a new definition.However,the pollutant discharge unit has insufficient understanding of the law of self-monitoring and ignores the responsibility as an obligatory subject;the division standard of the responsible subject is vague,the relevant specifications are missing,the self-monitoring data can't be reasonably applied,and resources are wasted;the supervision of self-monitoring of the pollutant discharge unit is not in place,and the monitoring data of the pollutant discharge unit is frequently falsified;the information disclosure of self-monitoring is insufficient,Limited public participation.These problems lead to serious environmental monitoring quality problems of pollutant discharge units,which are difficult to support the effectiveness of environmental supervision and further improvement of environmental quality.Therefore,in order to ensure the legality and effectiveness of self-monitoring data and improve the quality of self-monitoring data,it is necessary to standardize it in legal procedures.How to effectively supervise the self-monitoring behavior of pollutant discharge units,truthfully disclose the situation of pollutant discharge to the public,and ensure the authenticity of monitoring data is an important problem to be solved.The whole paper is divided int o four parts,including:The first part is an overview of the self-monitoring system of emission units in China.This paper mainly expounds the concept,content and relevant classification of the self-monitoring system of emission units in China,and furth er discusses the necessity of implementing the self-monitoring system of emission units.The second part is to analyze the current situation and legal problems of the self-monitoring system of pollutant discharge units in China.There are some problems,such as fuzz y standards of self-monitoring subjects,lack of relevant specifications,low professional level,high monitoring cost,low illegal cost,inadequate application of self-monitoring data,inadequate supervision,low degree of information disclosure and public participation.The third part mainly introduces the system and reference of self-monitoring of pollutant discharge units in foreign countries such as the United States and Japan.In the process of relevant legislation and implementation,countr ies outside the countr y have made clear the status of monitoring subject,ensured the authenticity and effectiveness of monitoring data,and the successful experience of self-monitoring internal supervision mechanism and strengthening training of pollutant discharge units is worth learning.In the fourth part,some suggestions are put forward to improve the problems in the operation of the self-monitoring system.It mainly includes improving the legal understanding of self-monitoring of pollutant discharge units,optimizing and solving the relevant legal problems of self-monitoring,strengthening the application of self-monitoring data,implementing the supervision of self-monitoring behavior,improving information disclosure and promoting public participati on,so as to further improve the effectiveness of self-monitoring system of pollutant discharge units.
