Research On The Legal System Of Environmental Information Mandatory Disclosure Of Key Sewage Units

With the China’s rapid economic development, the environment has been severely damaged at the same time, to strengthen environmental pollution control is the task of the moment. In order to deal with the environmental problems, China has established a legal system of environmental information disclosure, and the trend of environmental degradation has been alleviated with that. New "environmental protection law" for the first time clearly defined key sewage units must disclose their environmental information, to implement the provisions of the new "environmental protection law", followed by the introduction of the Ministry of environmental protection of the enterprises and institutions of environmental information open approach "specific provisions of the focus of the sewage units subject to mandatory disclosure of environmental information, the content, the way and the legal liability. The introduction of the regulations of the Ministry of key sewage units mandatory disclosure of environmental information of the implementation to establish a legal basis. However, in the implementation process, there are also exist some problems, for example, the standard to determine the key sewage units list is not high, the environmental protection department did not timely release list of the key sewage units, the environmental information disclosure of the content is not standardized, open manner is not specific, cost of illegal is low and the security system is not comprehensive, etc.In view of the above situation, this paper tries to focus on the sewage units of the legal system of mandatory disclosure of environmental information system research. First of all, the paper discussed the existing legal provisions for key sewage units mandatory disclosure of environmental information list and determine the main body of power, from a practical point of view of the problem of environmental protection departments, local government intervention and not as the main focus of the sewage units standard is not clear, and puts forward some thoughts of the environmental protection department of administration according to law and the weakening of local government intervention and to expand the focus of the sewage units the scope of the list; secondly, according to the content and focus of the sewage units exceptions mandatory disclosure of environmental information, discusses the existing regulations which are not different according to the characteristics of sewage units differentiating public content, exceptions to the provisions are too principle and other issues, exceptions should improve the different sewage units of environmental information disclosure and the specific provisions of the public; again, focus on mandatory disclosure of environmental information of the sewage units, the analysis of the existing law provisions of the existing problems and improve the open mode requirements. Finally, from the focus of the sewage units, the public and the environmental protection department angle construction units of key sewage environmental information compulsory public security mechanism, and put forward the establishment of environmental public interest litigation system, increase the cost of breaking the law and the implementation of the incentive mechanism and the preferential policies for the key sewage units.
