Research On The Legal Question Of Environmental Information Compulsory Disclosure Of Key Pollution Discharge Units

Frequent environmental incidents in China in recent years,such as the 2012 Longjiang cadmium pollution incident in Guangxi,and the 2020 Yichun Luming mining tailings pond leakage incident,etc.,which reflected a common problem,that is,the management and governance of key polluters insufficient.Since the pollutants produced by these enterprises will directly cause pollution and damage to the environment,the consequences,causes and treatment progress of such incidents should be carried out in accordance with the regulations and announced to the society in time,in order to emphasize the public’s right to know and supervision.Therefore,from this perspective,enhancing the publication of environmental information has a very important role in governing and managing these environmental problems and preventing the occurrence of such environmental problems.The newly revised<Environmental Protection Law>special provisions on environmental information disclosure have improved the level and effectiveness of legal regulations,strengthened the practical significance of the system and the significance of the system research,in order to better regulate the environmental information of key polluting units.The mandatory disclosure system,the<Measures for Disclosure of Environmental Information of Enterprises and Institutions>issued by the Ministry of Ecology and Environment has established a legal basis for the implementation of the system.However,the decentralized and lack of unified rules and standards are not conducive to the full play of the overall efficiency of the environmental information mandatory disclosure system of key polluters.Therefore,the improvement of the current regulations has a positive effect on the efficiency of the implementation of the system.In order to solve the legal problems in the compulsory disclosure system of environmental information of key pollutant discharge units,this article summarizes the relevant legal problems and proposes related solutions.First,an overview of the environmental information disclosure of key polluters.On the one hand,it clarifies the definition of environmental information disclosure and the basic concepts of key pollutant discharge units,so that the concept of compulsory disclosure of environmental information of key pollutant discharge units is clear and clear.On the other hand,the value analysis of the environmental compulsory disclosure system of key polluters is strengthened,and the emphasis on environmental issues is strengthened;at the same time,a solid theoretical foundation is laid for the improvement of the system.Second,analyze the current situation and problems in the implementation of the current environmental information mandatory disclosure mechanism.Explain the legal provisions and statutory exceptions of the environmental information disclosure of key pollutant discharge units in my country.Then,thelegal system was analyzed and researched,and the problems of fragmentation,narrow disclosure,insufficient disclosure,insufficient supervision mechanism,lack of relief channels and lack of reward mechanism were obtained.Thirdly,to explore foreign legal systems for disclosure of environmental information,and learn from the useful experience suitable for my country as a supplement to the development and improvement of the compulsory disclosure system for environmental information of key polluters.Fourth,sort out the shortcomings and deficiencies that exist in the process of environmental information disclosure of key pollutant discharge units in China,and on the basis of value measurement,put forward the provisions for merging environmental information disclosure,expand the scope of disclosure,improve the disclosure method,improve the relief channels,and increase great supervision efforts and the establishment of environmental information disclosure incentive systems and other perfect suggestions,and these recommendations as the corresponding specific solutions to resolve the legal issues of mandatory disclosure of environmental information.
