The new type of air pollution with the characteristics of cross regional superposition has brought challenges to the environmental management system of territorial management in China.The government has constantly innovated the air pollution control mode in practice to promote the improvement of air quality.At present,there are still some problems in the division of intergovernmental powers in the process of cross regional air pollution control in China,such as unclear powers and responsibilities between governments and departments at all levels,mismatching of powers and expenditure responsibilities,absence of cross regional management organizations,etc.,which cause local governments to evade the buck passing when dealing with cross regional affairs,and the difficulty of coordination between governments,thus restricting the process of cross regional cooperation in air pollution control.Therefore,based on the Jing Jinji region,this paper finds out the main mode of the division of power,analyzes the difficulties and causes of the division of power,and finally puts forward the institutional path to improve the distribution of power and the coordination of power and responsibilityThis paper takes the Jing Jinji region as an example,and sums up the following four modes of coordination of power and responsibility among governments in Jing Jinji region.First,government fragmentation,local management:Each sweeps his own snow.It shows that local governments act independently and their departments are fragmented.Second,Campaign-style Governance:Central decision-making and local implementation.It is manifested in the central government's unified regulation and compulsory mobilization of local governments to implement policies.Third,Regional emergency coordination:Transfer and concentration of local power.It shows that under the guidance of the central government,the local government transfers part of its power to the region and manages the regional emergency in a cooperative way.Fourth,Vertical reform of environmental protection department:the centralization and organization reconstruction of department power is manifested in the reallocation of some functions of environmental protection department,the strengthening of environmental supervision,the collection of environmental monitoring rights,the sinking and integration of environmental law enforcement forcesThrough the analysis of the power and responsibility coordination practice of air pollution control in Beijing Tianjin Hebei region,it is found that there are still many problems in the Intergovernmental power division of cross regional air pollution control.These problems affect the intergovernmental cooperation in cross regional air pollution control at different levels,including the joint governance of the central government and the local government,and the cooperation between departments.The core reason lies in the unclear composition of power between the government and departments,the overlapping of power boundaries,the continuous expansion of power scope,and the asymmetry of power and responsibility system.Therefore,it is necessary to optimize the government management system and the division system of administrative power,standardize the division of power and responsibility of the government for the cross regional air pollution control,and improve the efficiency and capacity of the government.Combined with the problems existing in the division of government's powers in the cross regional air pollution control in China,this paper puts forward the following suggestions:first,establish a list of powers and a dynamic adjustment mechanism.First,clarify the list of powers and clarify the responsibilities of government's powers and expenditures;second,integrate the government with the departments,powers and responsibilities to ensure that the powers and responsibilities are consistent and expenditures are guaranteed;third,establish a dynamic adjustment mechanism,define the boundary of power and responsibility,and form dynamic adjustment.Secondly,for cross domain affairs and cross powers,it is necessary to establish a conventional cross domain coordination mechanism,coordinate organizations,reconstruct functions and organizational systems,optimize the coordination of territorial management and vertical management,transform functional departments and break departmental barriers;collect cross domain affairs and powers,and establish a cross domain air pollution management organization.Finally,the establishment of power responsibility coordination and power responsibility balance mechanism,first,to ensure the government power responsibility coordination,not only through the law to give the authority of the main body,improve the corresponding legal system,establish a collaborative legislative mechanism,second,to improve the incentive mechanism,including political incentive,financial incentive,spirit incentive,etc.,to optimize performance appraisal and incentive methods;third,to establish the power responsibility balance mechanism,reduce each The imbalance of responsibilities among governments at different levels.
