With the improvement of the level of economic development and the continuous development and utilization of ecological environment resources,the environment on which human beings depend is gradually facing serious challenges such as environmental pollution and resource exhaustion.How to adopt relevant means in the judicial field,not only let the offenders pay the "price",but also let the relationship between "man and nature" be faced squarely through "who destroys,who repairs",correctly hear and handle all kinds of cases of damage to the environment and resources,respond to the concerns of the broad masses about the living environment,achieve judicial justice and social effects,and become the judicial practice of the new era.Major issues.The Eighteenth National Congress of the Communist Party of China upgraded the construction of ecological civilization to the strategic height of the "five in one" layout of economic and social development,and took "beautiful China" as the grand goal of the construction of ecological civilization.At the Third Plenary Session of the Eighteenth Central Committee of the Communist Party of China,it put forward "improving the system of environmental governance and ecological restoration",protecting the ecological environment with the system,and bringing new guidance to the people's court in carrying out the judicial Thought.The people's court carries out the ecological trial restoration work is an important way to explore the ecological environment protection,which has the functions of punishing,restoring and warning the "trinity".Specifically,by giving full play to the function of case trial,we can not only punish the environmental pollution and ecological damage,but also effectively restore the damaged natural ecological environment.At the same time,we can also play a good warning and education role for the public.Among them,the "green replanting" system is a relatively mature system in the judicial mechanism of ecological restoration.Based on the frame construction and practice of the system of "regreening and replanting" jointly formulated and implemented by Changchun Forestry District Court of Jilin Province,Changchun Forestry District Hospital of Jilin People's Procuratorate and Jilin Forestry Public Security Bureau,this paper intends to adopt the legal status and necessary clauses of the replanting agreement,the starting mode and application scope of the replanting system,the fulfillment mode of the replanting obligation and the inspection and acceptance of the system.With reference to the effective working methods of the judicial mechanism of ecological restoration in Fujian,Yunnan and Guizhou provinces,this paper explores the conceptual value,operation status,existing problems and solutions of the judicial mechanism of ecological restoration,and expands its application in civil and administrative trials for the future.The judicial mechanism of ecological restoration should be explored in order to provide reference for the realization of the dual objectives of judicial justice and social justice in the trial of ecological environment.
