research motive battery recycling policies,explore the use of funds,the deposit and compulsory recycling way promote the old power battery recycling,establish and improve the old power battery recycling system.On January 15,2016,"the electric vehicle power battery recycling technology policy"(2015 edition)clear again,the government needs to guide enterprises to carry out the design of the electric vehicle power battery,reasonable production and recycling work,establish linkage of upstream and downstream enterprises power battery recycling system,the implementation of producer responsibility system.And the comprehensive utilization of new energy vehicles used power battery industry rules,and so on,no matter which one policy,is clear about the development of an important principle,namely: encourage enterprises and push social force in the form of a variety of waste power battery recycling work,for power battery recycling,this is a very good policy guidance,also for the government to broaden the supervision channels,and improve the effect of the regulation.As the new energy automobile’s increasing year by year,so far,China’s new energy automobile ownership is close to two million vehicles,and pure electric vehicles has become the backbone of the new energy vehicles,to alleviate the increasingly serious problem of air pollution made an important contribution,at the same time,with the traditional gasoline-powered cars into competition situation,improve the overall level of auto industry in China.However,along with the rapid development of new energy automotive industry,its problems are also growing,especially for the first batch of power battery scrap,and power battery recycling follow-up questions,makes the development of power battery has become the focus of the society from all walks of life,because of less formal recycling companies,recycling channels are limited,a large amount of waste power battery into illegal trader hand,at the same time,due to the complexity of power battery design,dismantling technology standard is high,the pollution to the environment due to illegal dismantling power battery phenomenon,has seriously affected and restricted the orderly power battery recycling business.While condemning the illegal behaviors of those responsible,the public also pays more attention to the government,which is the supervisor of waste power batteries,and questions whether there is insufficient supervision or a lack of supervision.Therefore,in order to ensure the healthy development of the recycling of used power batteries,it is the most important task to clarify the responsibilities of all parties and improve the legal system.As for the recycling and utilization of power accumulator,the related research has carried on the analysis on different levels from various angles,among which there are many discussions worthy of reference.However,the existing research mainly focuses on automotive engineering,chemical materials and other fields,and there are few studies in the field of law.This paper will focus on the legal system of power battery recycling,through sorting out the legislative status quo,further explore the existing legal system of power battery recycling,the defects,and put forward Suggestions for improvement.From the concept of "power battery",further clarify the "power battery","starting batteries",the relationship between the "batteries",is conducive to a deeper level of understanding the significance and necessity of power battery recycling,and the power battery recycling status quo and current problems were analyzed,and then suggests the necessity of perfecting the legal system of power battery recycling and clear responsibility,the importance of strengthening government supervision.In recent years,the state has actively encouraged and supported the research,development and use of new energy vehicles in order to develop a recycling and energy-saving economy.And the power battery plays a vital role in the development of new energy vehicles,and its stored electricity is part or all of the direct energy source of new energy vehicles.Therefore,how to improve the power battery cycle utilization rate,is now worth exploring one of the important issues.This paper will take the existing laws and regulations of our country as the entry point,systematically sort out relevant legislative provisions and policies,and deeply explore the current situation of China’s legal system of power battery recycling,and on this basis,find problems and defects,so as to pave the way for better solution.In addition,most industrial countries attach great importance to the legal regulation of waste batteries,because they have realized that the cost of environmental pollution caused by waste batteries is much higher than the cost of prevention.However,the destruction of soil structure and underground water pollution caused by waste batteries are costly or even irreversible.Therefore,the United States is one of the most representative countries in the legal system of waste batteries aimed at developing a circular economy.The United States as a developed country,its cumulative,on the basis of a large amount of practical experience,set up a relatively mature legal system,in terms of power battery recycling,the United States is a typical responsibility sharing type,this type stressed that should not be powered battery after BaoFeiQi assume all responsibility by production enterprises,government,sellers,importers and consumers should bear corresponding responsibility.This method avoids the simplification of responsibility,and at the same time broadens the regulatory channels for government departments.It can provide valuable reference for the improvement of China’s legal system of power battery recycling.Finally,based on the concrete practice in our country,and draw lessons from foreign mature experience,from the legal system,running mechanism,responsibility distribution of the three aspects,to perfect legal system of power battery recycling in our country,puts forward the choice of operable path,specific as follows: establish a complete power battery recycling law regulation system,set up under the government regulation of market operation mechanism and by clearly define the responsibility of power battery recycling allocation,to promote the healthy development of the power battery recycling system.
