Research On Ecological Compensation Legislation Of Construction Waste In Taiyuan City

In recent years,China’s urbanization process accelerated,urban construction in full swing,resulting in a large number of construction waste,but also brought serious environmental problems.With the continuous development of China’s economy and society,the development of urbanization has promoted the continuous expansion of the construction industry,and the problem of pollution and disposal of construction waste has become more prominent.Construction waste has become an important pollution factor in urban construction and development.With the development of economy,the original construction waste management system is out of the market.At the same time,the construction waste pollution control legislation in China also has many defects.The newly revised regulations on the management of urban construction waste allocates the rights of the government and environmental protection administrative departments.We strengthened environmental law enforcement,added a series of prohibitive regulations,and strengthened the penalties for fines.Major breakthroughs have been made in legal liability.However,in the specific implementation of the legal norms,there is still a gap in the legal measures,so it is necessary to formulate supporting rules to regulate the whole process of construction waste prevention and control.Traditional construction waste pollution management methods are more from the perspective of pollution prevention and control,more is the use of an administrative way to regulate the disposal requirements of construction waste and violation of the provisions of punishment standards.There will also be financial penalties for companies and individuals that violate the rules.But it is more of an administrative law in nature.The management of construction waste is not only to protect the environment and combat the pollution of construction waste,but also to improve the recycling level of construction waste,improve the efficiency of resource use and save resources.Therefore,the traditional construction waste pollutionprevention law is not suitable for the current social development requirements,especially the requirements of environmental protection and resource conservation.Therefore,this paper will analyze the theoretical basis and practical links of the legislation of ecological compensation for construction waste in taiyuan city based on the relevant theories of ecological compensation.This article summarizes the construction waste because of the urbanization process at present many problems exist,and combined with the legislative experience of taiyuan city construction waste management regulations,to the our country present legal basis is discussed several kinds of construction waste management mode of different development space,and then from the Angle of ecological compensation,study of the construction waste disposal policy framework and legislative Suggestions.
