Research On Legislation Of Marine Ecological Compensation In China

After the rapid development of the economy entering the 21st century in China,over-exploitation of land resources has led to serious damage to ecological resources and the environment,which has spurred economic development to gradually expand from land economy to marine economy.In the early stages of marine economic development,focusing only on the rich benefits of marine development and utilization,and neglecting the protection of marine ecological resources and the environment,led to the frequent destruction of marine ecological resources and environmental accidents.With today’s emphasis on building a maritime power,we cannot "pollute first and then treat" as we did in the past using terrestrial ecological resources and the environment.While developing and utilizing marine ecological resources and the environment,we must begin to repair and protect them.Therefore,it is necessary to form a balance between development and ecological protection.Ecological compensation is a system that promotes its balance.Among them,marine-related ecological compensation is the marine ecological compensation system.At present,China’s marine ecological compensation is still in the theoretical research stage,and the legal system of marine ecological compensation has not yet been established.At this stage,policies and local regulatory documents in some cities and cities are the basis for marine ecological compensation practice.This thesis presents methods for proposing,analyzing,and solving problems,combined with China’s existing policies and legislation on marine ecological compensation,as well as practices,to analyze the current problems,and to propose suggestions for improving the legal system for marine ecological compensation.This thesis is divided into four parts to analyze:The first part is the analysis of the basic concepts of marine ecological compensation.Analyze and determine the concepts and contents of ecological compensation and marine biological compensation,distinguish ecological compensation and related concepts,and analyze the particularity of marine ecological compensation.The second part is the analysis of my country’s marine ecological compensation policies and laws.The relevant policies and legislative status of my country’s marine ecological compensation are sorted out,and combined with the analysis of my country’s marine ecological compensation practice.The third part is to ask questions and analyze them.It puts forward that my country’s marine ecological compensation legislation has problems such as insufficient legal support,unclear main body and standard of compensation,and imperfect compensation system.The fourth part,through the above analysis of China’s marine ecological compensation,puts forward suggestions from the basic framework,main content,operation management and supporting mechanisms,specifically including the selection and basic principles of China’s marine ecological compensation legislation,compensation subjects,standards and methods And make detailed explanations on the balance between development,utilization and protection of marine ecological resources and the environment.
