Legalization Of Guizhou Province Ecological Compensation Research

Ecological environment, as the basis for human survival and economicdevelopment, provides natural resources, ecosystem services and living space forhuman being. Ecological security is an important component of national security. Thefragile ecological environment in Guizhou province threatens the country’s ecologicalsecurity and its unique natural geographic environment has made an importantcontribution to the protection of ecological environment. The establishment ofecological compensation legal system will effectively protects national ecologicalsecurity. Existing ecological compensation policy in Guizhou province has a lot ofdefects and research on the theory and practice of ecological compensation legalsystem is weak, especially in the practice of ecological compensation which calls forecological compensation law. Due to the low standard of economic compensation,zero receive of compensation payments by famers, fail to imply the matching fundsbecause of finance limited，lag of subsequent industrial development, some regionsespecially in the ethnic minority areas are facing increasing trend of poverty.The mainly introduces the basic theory of ecological compensation legal system,the concept and connotation of ecological compensation and the subject, object,content in legal relationship of ecological compensation. In second part, the authorsupposes that ecologic compensation is the need to coordinate survival right,development right and environment right. Besides, ecological compensation is thenecessity to realize coordinated development between ecology and economy. Byanalyzing the status of ecological compensation in local regulations and localgovernment regulations as well as normative file, the author points out several mainproblems which are the lack of comprehensive regulations, unbalanced state amongexisting regulations, government regulations and policies, the simplicity ofcompensation area and so on. Primary analyzes ecological compensation experienceat home and abroad, part three learns from the national framework for the eco-compensation bill, specific content in local regulation, legal system of ecologicalcompensation in foreign countries, regional cooperation mechanism and diversification of public payment. Part four puts forward main countermeasures forlegal consideration of ecological compensation in Guizhou province, includinglegislative trends of national ecological compensation, legislation in other provincesand present legislation in Guizhou province which are the basis for ecologiccompensation legislation, basic principals of ecological security, combination ofecology and economy, beneficiaries compensation and combination of compensationand aid-the-poor. At the mean time, the author proposes that the main way ofecological compensation legislation is to formulate ecological compensationregulation and to improve existing local regulations of ecological compensation inGuizhou.
