Research On Legal Issues Of Nuclear Material Supervision In China

At present,China's nuclear material supervision is regulated by the Nuclear Safety Law.The current effective nuclear material control administrative regulations are the Nuclear Material Control Regulations promulgated by the State Council.International treaties and major nuclear powers have provisions on nuclear material regulatory systems.The relevant international treaties include the Treaty on the Non-Proliferation of Nuclear Weapons,the Convention on the Physical Protection of Nuclear Material,and the Physical Protection of Nuclear Materials and Nuclear Facilities.Large countries have established regulatory frameworks for nuclear materials in their domestic laws.China's nuclear industry started late,and the legal system for nuclear material supervision is still in the process of development and improvement.This study combs the current situation of China's nuclear material regulatory system and the main measures of China's nuclear material supervision,finds the provisions of international treaty on nuclear material supervision,and sorts out the legal systems involving nuclear material supervision in the United States,Russia,South Korea and France.To analyze and compare China's problems in nuclear material supervision,and to make reasonable suggestions for existing problems.After systematic research,the legal system of nuclear material supervision in China consists of laws,administrative regulations,departmental rules and national standards,and has formed a relatively complete legal system.The regulatory measures for nuclear materials mainly include license management,nuclear material accounting and nuclear.Physical protection of materials.The basic principles,the transportation of nuclear materials,the use of international cooperation in the crime of nuclear materials,the physical protection of nuclear materials,and the classification of nuclear materials are all reflected in international treaties.Comparing the relevant provisions of international treaties and the laws of four major nuclear powers,it is concluded that the legal system of nuclear material supervision in China still has problems such as unclear division of supervisory duties,cumbersome establishment of statutory regulatory bodies,public participation in nuclear material supervision,and expert participation.In the future,China's nuclear material supervision should implement the clear division of supervision duties,appropriately streamline the establishment of statutory regulatory agencies,establish the principle of information disclosure in nuclear material supervision and the system of expert participation.
