In recent years,climate change has risen to the global issue,bringing multiple impacts to human society,addressing climate change and promoting resource transformation have become the common proposition of the entire international community,and carbon emission trading has become the main path for greenhouse gas emission reduction.As a country with a large population and a large carbon emitter,China is still in the exploratory stage in the legal framework of the carbon emission trading market.In the internationally accepted MRV regulatory system,the professional advantages of third-party verification agencies make up for the lack of government regulation,but it is difficult to escape the barriers of interest linkage.With the emergence of carbon peaking targets,a series of supporting policies have made it clear that third-party verification agencies will participate in the trading of carbon emission allowances,which is also indispensable for the construction of a carbon trading market.However,third-party verification agencies are not born into being,and in reality,problems such as collusion between companies and falsification of carbon emission reporting data have been repeatedly exposed.Fundamentally,the supply of legislation is not enough to meet the healthy development needs of China’s carbon emission trading market.This paper analyzes the regulatory system of third-party verification institutions,draws on extraterritorial experience,examines the practical problems of supervision of third-party verification institutions in China from the perspective of law and economics,analyzes the pros and cons of different regulatory strategies,and puts forward specific suggestions.This paper is divided into the following five parts:Introduction: summarizes the background and significance of the topic selection,and briefly points out the views,innovations and shortcomings of the paper.Chapter 1: A basic overview of third-party verification agencies in carbon trading.This chapter defines the research subject of the paper as a third-party verification agency,analyzes the legal status,verification scope and principle requirements of the third-party verification agency,and analyzes the utility of the third-party verification institution from the perspective of law and economics.Chapter II:Regulatory Status of Third-Party Verification Agencies in China’s Carbon Trading.On the legislative practice and judicial status of third-party verification institutions,point out the existing problems,analyze the legal relationship of the subject and the pattern and cause of typical illegal acts,and examine the current regulatory status in China.Chapter 3: Economic Analysis of the Regulatory Effectiveness of Third-Party Verification Agencies in China’s Carbon Trading.It is divided into pre-event selection,in-event game,and post-event punishment,with the aim of achieving optimal law enforcement.Chapter IV: Establish a supervision system for third-party verification bodies.Achieve all-round regulatory requirements from multiple perspectives such as legislation,law enforcement,and justice,and put forward standardized improvement suggestions for effective supervision of China’s third-party verification institutions on the basis of drawing on extraterritorial experience.
